Comments and Analysis

This company sells golf clubs through telephone and fax soliciations. The company tells prospects test their clubs without obligation for 90 days. Customers are asked to supply credit card information at the time of the transaction. In December, 1998, the company told us that they treat all transactions as sales, not tests, and that they offer a 90 day guarantee. On February 18, 1999, the company advised the Bureau that they will be closing their doors effective the end of February. The company started crediting customers as much as possible and fulfilled as many orders as they could. The company further stated, that arrangements have been made with their merchant processor to settle the issues with customers that need credit to their cards. We recommend careful consideration of what options may be available once the 60 days have elapsed. By law, consumers have 60 days from the billing date to dispute the charge with the credit card company. After the 60 day period, a charge cannot be reversed unless the seller consents. If the order is canceled, we suggest that the product be returned in sufficient time to permit a credit card dispute to be filed.
