This company sells a teeth whitening product which is advertised via infomercials, and the internet as a 14 day free trial offer. The trial offer is advertised as free, however, respondents are required to pay shipping and handling by means of a credit or debit card in order to receive the free trial. Upon ordering, you are agreeing to pay the shipping and handling fees for the free trial shipment. If you do not cancel the trial, the company will send another shipment in 14 days from your free trial purchase date, and every 30 days thereafter you will be automatically shipped another 30 day supply, and you credit or debit card will be automatically billed a total of $88.97 monthly.

The website terms and conditions for the product indicate there is a 15-day satisfaction guarantee return policy on all shipments. To return a product for an exchange or to avoid being charged you must cancel before your 14 day trial period is over. You may cancel your Value Autoship Program by calling 1(866) 440-7533 Monday thru Friday 8am-5pm Pacific Standard Time or emailing our support department at support@advancedbright.com. To return or exchange merchandise, you will need to obtain a Return Merchandize Authorization (RMA) number by contacting the billing department at support@advancedbright.com.

Free trial offer promotions for monthly membership or continuity shipments usually have marketing materials sent with the product or service which will allow a specified time period for cancellation and return without penalty or obligation. However, many overlook the advisories, and are unaware of the unfamiliar charges until their next monthly credit card statement. Sellers must give you information about the plan's terms and conditions, clearly and conspicuously, in their promotional materials. These terms may include; that you become a member if you accept the introductory merchandise or initial round of services, unless you cancel; or that periodic delivery of merchandise or services will occur - with no further action on your part; and will continue until cancellation is received. It also must disclose a description of the merchandise or services you agree to buy, say whether there's a minimum purchase, and how often you'll receive the products or services. An explanation of the plan's billing procedure for each shipment or period of service must also be provided, as well as the terms of the plan's refund or return policy; how and when you can cancel your membership; and the price of the goods or services if you fail to cancel, including shipping and handling, if applicable.

Other Considerations

The Federal Trade Commission's Mail Order Rule allows the seller 30 days to ship ordered products to the buyer unless otherwise specified at the time of purchase. If the seller cannot ship within the 30 day period, they are required to notify the buyer in writing of the delay, and give the option of waiting, or having their money returned within seven days. Credit card payments must be credited within one billing cycle.
