Complainants generally allege that the company does not provide the promised rental lists or that it misrepresents the types of rentals available. Some customers report that the properties they were provided were rented, were apartments or condos when they requested houses, the rents did not agree with those listed, or the addresses were incorrect. One landlord wrote that the list stated the rent was for $1000, but in fact, it is $2000 and they have no agreement with the company to list the property. Most complainants state that when attempting to obtain a refund or to contact the company about these discrepancies they are left on hold or hung up on by company representatives. All complaints remain unanswered.

California law requires anyone conducting a prepaid rental listing services to be licensed by the Bureau of Real Estate with a Prepaid Rental Listing Service (PRLS).  A real estate broker’s license will also satisfy this requirement. Anyone licensed to conduct such business, unless licensed as a real estate broker, must also maintain a bond in the amount of $10,000 for each location. You may check the status of a real estate broker  licensee by writing to BRE, 1651 Exposition Blvd., Sacramento, CA 95815, by calling 1-877-373-4542, faxing 916-227263-8943, or visit their website at http://www.bre.ca.gov. On February 27, 2004, we verified that this company is not registered with the Department of Real Estate as a pre-paid rental listing service. Companies offering rental lists, either as prepaid rental services or as credit reporting services providing free lists, must be licensed by the State Department of Real Estate and maintain a $10,000 bond for each of its locations. To verify licensing call, (916) 227-0931 or visit www.dre.ca.gov. According to California Law, contracts must include the prospective tenants' specifications for the rental property, a clause in bold type letter outlining the small claims court remedy available, and a right to refund in bold capital letters. A full refund shall be made, if the client is not provided at least three rental properties meeting the tenant's specifications within five days after execution of the contract, unless a rental is obtained utilizing the service. The request for return of fees must be made within ten days following the five-day period by delivery or certified mail and all fees over $50 shall be refunded to the tenant, if a rental is obtained other than through the company's services or the client does not obtain a rental. The client must make demand for a partial refund by supplying reasonable documentation within ten days after the contract expiration.
