On August 31, 1998, Kelby Smith, owner of Apex USA, Inc. advised our office that their marketing agreement with Scimitar Golf was terminated on July 14, 1998. Apex USA used to be a marketer for Scimitar Golf products and is claiming no responsibility for defective material and/or workmanship of golf clubs produced. Since the termination of the agreement, Apex USA products are manufactured by Accuron, Inc. The company has also advised our office that they will be going out of business. This company solicits the sale of custom-made golf clubs by faxing surveys and making calls to potential customers. The company has a 30 day money back guarantee if consumers are not satisfied with the clubs. Credit card information is requested at the time of the transaction. Complaints typical of golf club telemarketing generally allege failure to deliver, difficulty obtaining refunds after returning the clubs, misrepresentation of credit card processing dates, and dissatisfaction with product quality. Consumers deciding to test golf clubs should consider doing it without issuing payment or credit card information. Any information supplied to the company should be given after the trial period, and only if you want to purchase the agreement. By law consumers have 60 days from the billing date to dispute the charge with the credit card company. After the 60 day period, a charge cannot be reversed unless the seller consents. If the order is cancelled, we suggest that the product be returned in sufficient time to permit a credit card dispute to be filed.
