Licensing

The Florida seller of travel statute regulates a broad range of travel services including individuals and entities that sell or offer to sell prearranged travel tourist related services or tour guides services which includes air sea and land. Florida Statute 559.926 et seq. The distribution of travel certificates in Florida is also highly regulated as the state requires a $50 000 bond and extensive disclosure requirements for the seller of travel. For this reason many sellers of travel restrict the distribution of certificates in Florida and make a notation on their other certificates “not for distribution in Florida.” Florida also requires independent agents to register but they are not required to post a bond as long as they meet standards as determined by statute.~~

Comments and Analysis

The Business Consumer Alliance advises consumers to be skeptical if you receive a free vacation offer. Although some promotional offers are legitimate many are not. Some companies use deceptive or misleading solicitations which do not clearly disclose the true nature of the offer hidden fees associated with the offer or potential problems with scheduling due to black out dates and seasonal demands. ~~Vacation vouchers are generally used as buyer incentives for other products or services such as timeshare presentations or travel club memberships. Find out if you will be required to attend a timeshare presentation in order to be eligible for your free vacation. ~~Keep in mind that vacations advertised as free should not cost you any money. In our experience these offers often have numerous undisclosed costs sometimes totaling hundreds of dollars. Generally the vouchers do not include things like transportation costs hotel taxes incidentals fuel surcharges State sales tax Government taxes Gratuities and port fees.~Ask about the company’s cancellation and refund policies. Fees are generally required to be paid in advance if you cancel you may be committing to forfeiture of all fees paid.~~According to Florida's ""Sellers of Travel Act"" you may cancel the contract without any penalty or obligation within 30 days from the date you give or sent a signed contract and payment to the seller/promoter unless you are given a guaranteed travel date. ~~Verify that the company is registered as required by state law contact the Florida Division of Agriculture & Consumer Services at: 850-922-2832. Remember even if the company is registered with the State this does not in itself afford you the assurance of legitimacy.~ ~~~
