BCA's Summary and Analysis:

Complainants allege unauthorized credit or debit card charges, false advertising, failure to honor their money back guarantee, and inability to obtain refunds. Other customers complain the product does not work as advertised. Most complainants also allege that disclosures regarding the terms and conditions of the offer are unclear, or they are unable to obtain RMA numbers to return products when attempting to cancel, or that when returning products, the company claims the products were never received. Others complain that although they are promised refunds, the company fails to send them.

The company responds to some complaints by agreeing to issue full or partial refunds, disputing allegations, or offering explanations or clarification of their policies, terms and conditions. Allegations of false advertising and incomplete disclosures are generally not addressed. A few complaints are unresolved meaning the company failed to properly address the complaint allegations or their response was inadequate.

Comments and Analysis

This company sells a colon clensing product via website sales promoted by a "14 day free trial offer" Upon ordering you agree to pay the shipping and handling fees for the fee trial bottle. The trial offer is advertised as free, however, respondents are required to pay shipping and handling by means of a credit or debit card in order to receive the free trial. If you do not cancel the trial, the company will send another shipment in 14 days from your free trial purchase date, and every 30 days thereafter you will be automatically shipped another 30 day supply. The monthly supply shipment consists of 2 bottles (30day supply) for $34.99 per bottle plus shipping and handling of $8.99 for a total of $78.98 for the monthly supply ( two bottles). . This will be shipped to you every month until you decide to cancel, and the same credit or debit card you used to pay for the free trial wll be automatically billed.

To avoid being charged you must cancel before your 14 day trial period is over. The company does not issue refunds for orders that have already been shipped. The company's terms and conditions state that you may cancel your Value Autoship Program by calling 1(866) 440-7533 Monday through Friday 8am-5pm Pacific Standard Time or emailing our support department at support@Colon700.com . The company charges a $7 restocking fee for each bottle that is returned, and do not refund shipping and handling costs.

Free trial offer promotions for monthly membership or continuity shipments usually have marketing materials sent with the product or service which will allow a specified time period for cancellation and return without penalty or obligation. However, many overlook the advisories, and are unaware of the unfamiliar charges until their next monthly credit card statement. In some cases, consumers find they are unable to contact the company to arrange returns or ask for credit. Most credit card issuers will allow the cardholder 60 days to dispute an unauthorized or inaccurate charge. Review your monthly statement carefully. If you discover a charge which is unfamiliar, investigate and dispute the amount with your card issuer as soon as possible to protect yourself from making unwanted purchases.

Often, you can unknowingly join a plan simply by accepting an introductory offer of merchandise or services. Continuity plans may offer an introductory "free trial period" to let you check out the merchandise or service and decide whether to join the plan. If you keep the merchandise beyond the free trial period or fail to cancel the service within the free trial period, not only must you pay, you automatically become a plan member. Joining a continuity plan means you agree to the plan's sales method as long as you're a member. You'll automatically get periodic shipments of merchandise or delivery of services. You won't get any announcements or rejection forms before each shipment or service period. The shipments or services continue until you cancel your membership.

Sellers must give you information about the plan's terms and conditions, clearly and conspicuously, in their promotional materials. These terms may include; that you become a member if you accept the introductory merchandise or initial round of services, unless you cancel; or that periodic delivery of merchandise or services will occur - with no further action on your part; and will continue until cancellation is received. It also must disclose a description of the merchandise or services you agree to buy, say whether there's a minimum purchase, and how often you'll receive the products or services. An explanation of the plan's billing procedure for each shipment or period of service must also be provided, as well as the terms of the plan's refund or return policy; how and when you can cancel your membership; and the price of the goods or services if you fail to cancel, including shipping and handling, if applicable.

Other Considerations

The Federal Trade Commission's Mail Order Rule allows the seller 30 days to ship ordered products to the buyer unless otherwise specified at the time of purchase. If the seller cannot ship within the 30 day period, they are required to notify the buyer in writing of the delay, and give the option of waiting, or having their money returned within seven days. Credit card payments must be credited within one billing cycle.
