Donate Timeshares

On July 14, 2014, the California Bureau of Real Estate (“BRE”) filed a Desist and Refrain Order against Donate Title, Inc. (“Donate Title”), Tony Espinoza (“T. Espinoza”), Roxanne Espinoza (“R. Espinoza”), David MacMillan (“MacMillan”), Chris Bodig (“Bodig”), and other companies that shared a common enterprise. Based on the investigation the BRE determined that Donate Title, T. Espinoza, R. Espinoza, MacMillan and Bodig had engaged in acts or practices in violation of the California Code of Regulations, and the California Business and Professions Code. The violations include, but were not limited to: claiming, demanding, charging, receiving, collecting or contracting for the collection of an advance fee; and performing and/or participating in the business of, acting in the capacity of, or advertised a timeshare resale service offering to obtain transfers of legal title from timeshare owners to recipient buyers for fees collected in advance of the transaction, as well as advance fee handling which require a real estate broker license.

According to the BRE during a period of time, Donate Title, T. Espinoza, R. Espinoza, MacMillan and Bodig were not licensed by the BRE to perform real estate broker services. The Desist and Refrain Order prohibits Donate Title, T. Espinoza, R. Espinoza, MacMillan and Bodig, whether doing business under their own names, or any other names, or any fictitious names, from performing any acts within the State of California for which a real estate broker license is required.
