This law also prohibits charging for such services as; registering or listing the artist for employment, providing photographs, videotapes, other promotional materials, costumes, lessons or training, or auditions. On February 5, 2018, Prime Sites, Inc. doing business as Explore Talent and the Federal Trade Commission (FTC) reached a settlement regarding allegations that the Company violated the Children’s Online Privacy Protection Act Rule (COPPA) and misleading prospective purchasers with false claims that paying for Explore Talents premium services would get them employment with casting directors. Explore Talent has agreed to pay $235,000 in civil penalties.
The FTC’s Complaint alleges Explore Talent violated the COPPA Rule by collecting and disclosing children’s personal information without obtaining parental consent. Explore Talent also falsely claimed in their Privacy Policy that it does not knowingly collect personal information from children under the age of 13. The Company did not detail to parents and the public its collection, use, and disclosure practices.
In addition, the Complaint also alleges that the Company violated the FTC Act by deceptively representing to prospective purchasers of its premium services that casting directors either had interest in them or had specifically chosen them for upcoming roles.
In addition to the $235,000 civil penalty, Explore Talent is required to comply with COPPA requirements in the future and to delete the information it previously collected from children.
