We believe this company is required to register with the California Attorney General as a telemarketer and post the required bond. The company has not registered as of May 12, 1999. This company sells golf clubs by allowing recipients to test the clubs without obligation for a period of 60 days. Customers are required to pay a deposit on a major credit card prior to receiving the clubs. The company states the deposit is for security purposes to ensure that the golf clubs will be returned if the customer is not satisfied. Our experience with similar offers indicates many golf enthusiasts have lost their money to telemarketers who used a marketing technique very similar to this company's method. Generally, the telemarketers contact golf enthusiasts by phone and offer a set of golf clubs to try on a trial basis at no cost or obligation to purchaser. Participants are asked for credit card numbers for billing and security purposes. When attempting to return the clubs as agreed, they discovered they were unable to reach the company to arrange pick ups, and their credit cards had been charged, sometimes in excess of $1500. In some cases, complainants who returned the clubs never received credit for the return. It appears the company may be out of business. Mail was returned by the post office as "Attempted Address Not Known" or "Undeliverable". By law, consumers have 60 days from the billing date to dispute the charge with the credit card company. After the 60 day period, a charge cannot be reversed unless the seller consents. If the order is cancelled, we suggest that the product be returned in sufficient time to permit a credit card dispute to be filed.
We know of no other matter or practice relating to this company that may assist you in your consideration of this company.
