Agency: California Bureau of Real Estate ~Description:

~ In April 2012 the California Bureau of Real Estate (“BRE”) filed a Complaint against First Federal Loan Services Inc. (“FFLSI”) and Orlando Guba Ungos (“Ungos”). Based on the investigation the BRE determined that FFLSI and Ungos had engaged in acts or practices in violation of California Business and Professions code.  The violations include but were not limited to; collecting or receiving advance fees for performing loan modifications failing to keep transactions and records and employed and compensated unlicensed and unbounded individuals.

~ According to the Order all licensing rights of FFLSI were Revoked. The licensing right of Ungos were suspended for six (6) months and was ordered to pay a monetary penalty and pass the Professional Responsibility Examination. This decision became effective on June 3 2013.

Comments and Analysis

Effective October, 2009 in California, it is illegal to collect any fees, regardless of the form, for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.

HUD approved housing counseling agencies are exempt from this law. For businesses outside of California, please check with the agency that regulates this industry.
