The Better Business Bureau advises homeowners to be aware that many companies present unrealistic offers of foreclosure prevention. The Bureau recommends contacting your mortgage lender as your first step when you realize you could face foreclosure. Nonprofit organizations designed specifically to assist financially distressed homeowners with foreclosure issues can help also. One these is the Homeownership Preservation Foundation, which can be contacted at www.hopenow.com or by calling 888-995-HOPE. Finally, homeowners should be aware that a legitimate loan modification service will include an evaluation of eligibility without a separate charge. Effective October, 2009 in California, it is illegal to collect any fees, regardless of the form, for negotiating or attempting to negotiate a loan modification for a residential mortgage. All modification services must be fully completed before any money can be collected. It is also illegal to divide fees or services into components for the purpose of avoiding this law.HUD approved housing counseling agencies are exempt from this law.
