In California, a business opportunity offer must include written disclosures, cancellation notices, and certain contract provisions. Documents should in part, contain the terms and conditions, description of services, payments, length of time the plan is offered, number of purchasers, and substantiation of any claims made regarding earning potential. If more than 20 percent is needed to an initial payment prior to delivery of product or service, the contract should reflect an established escrow account. Investors have a three-day right to cancel. Refunds must be issued within five days of receipt of the cancellation notice. A contract may be voided within one year from the date the contract if any misleading statements are used or the company fails to provide proper documentation of the offer.
