Comments and Analysis

California Law requires that any company offering to procure, offers, promises, or attempts to procure employment must register and post a $10,000 surety bond with the California Secretary of State. These companies are also required to provide you with a written contract which includes: basic company information, fees charged, description of services, explanation of your three-day cancellation rights, and refund rights. As of June 13, 2003, we could find no evidence of bonding or licensing. This company's contract also specifies that it will refer you to their immigration lawyers, which by law, requires them to post a $50,000 bond with the California Secretary of State and register as an Immigration Consultant. The company is also required to inform you of a 3-day cancellation right in writting and provide other specific information about the services to be performed. As of June 13, 2003, we could find no evidence of bonding or licensing. In general, should the company fail to inform you of your cancellation rights, your rights still exist until you receive written notification. The company must provide a full refund, despite any contractual provisions to the contrary.
