California law requires anyone conducting a prepaid rental listing services to be licensed by the Department of Real Estate. A real estate broker’s license will also satisfy this requirement. Anyone licensed to conduct such business unless licensed as a real estate broker must also maintain a bond in the amount of $10 000 for each location. This company advertises on Craigslist and various internet sites. They offer property lists which purportedly include rental and forecloseure listings. Service levels are offered via two plans a Silver or Gold service. The Silver service is offered at a cost of $130 for 6 months. The Silver Package is said to be specially designed for the Do It Yourself realty deals finder compiling all deal listings on one data base. The Gold package is offered at $260 for six months. The Gold Package is designed for individuals and families and is said to provide custom search options. ~~The company's website does not display a telephone number or a fax number. ~~Consumers should read and understand all "Terms and Conditions" before making a buying decision. The company's cancellation and refund policies require buyers to use the service for 6 months before a refund can be requested and also warn buyers that any attempt to dispute the service fees with their credit or debit card issuer will result in the company mounting a strong defense to aggressively contest the dispute which will affect and delay Buyer's ability to receive a refund. ~~In general complaints against rental listing services allege that the properties advertised do not exist or that the listings are not current and the properties were already rented were never for rent or authorized by the owner to be listed or do not meet the criteria of the person seeking the rental. Other allegations are that the properties listed were taken from ads in other sources such as newspapers or Internet websites. Refunds even if provided for in the contract are extremely difficult to obtain.~~California law requires companies offering rental listings to enter into a contract with you before accepting their fee from you and the contract is subject to certain requirements. First it must expire no longer than 90 days from the time you execute it. It must include besides specifically what you are seeking in a property a provision for refunding anything you paid over $50 to you if you obtain a rental elsewhere and a provision for refund if they do not provide you at least three available rentals meeting your specifications within five days after you paid your fee. It must also outline the small claims court remedy that is available to you.

Other Considerations

If you are considering purchasing a foreclosed property there are a few ways to do it. Home buyers can purchase foreclosed properties through pre-foreclosure which allows you to purchase a house directly from the homeowner before it goes into bank foreclosure; at auctions where you will bid against other interested buyers; or properties that are Real Estate Owned also known as REO.~~Conduct a “title search.” This process can help you find out whether the property has a second mortgage or lien against it. If it does you may be responsible for paying off the initial mortgage any second mortgage loans and any liens on the property before you can take ownership.~~Be aware that if you purchase the house in an auction you may not be able to look inside the home or conduct a home inspection in advance of the sale. Properties sold at auctions are usually sold “as is.” This can create problems when trying to obtain a mortgage loan.~~Obtain help if you need it. Find a real estate agent that is experienced in foreclosures. Have your agent check nearby or comparable homes to see if the asking price for a foreclosed home is in fact a bargain. Foreclosure laws vary from state to state so check the laws in your area by contacting your county clerk’s office.~~Listings for all auctions and foreclosures in USA are in public domain and must be distributed free. If you think that the information sold to you by a paid list provider is useless you should demand an instant refund! If you feel you were a victim of the fraud committed by the for-profit foreclosure list provider you should call your District Attorney’s office and the BBB.
