This company sends out official looking misleading solicitations which indicate the recipient is eligible to particitpate in a mass joinder lawsuit against their mortgage lender. The offer is advertised as a means to stop foreclosure have interest rates reduced provide relief and monetary damage awards and deliver houses free and clear within 18 to 24 months. The company asks for an up front retainer fee. The addresses shown on the company's website is a virtual office not a physical loffice location. The company's website registration shows the site is registered to Roy Barnhart at 15061 Springdale St Suite 206 Huntington Beach California 92649. Mr. Barnhart previously operated USLMP from the same address. USLMP was was the subject of numerous complaints to the BBB and currently has a F rating. Consumers nationally are receiving official-looking forms that declare "You may be a plaintiff in a national mass joinder suit.” The mailing may imply that fraud may have occurred when you financed your home and that the author of the mailing can assist you in seeking restitution. The form explains that you might be eligible to "become a joined named plaintiff in a national lawsuit that will seek among other things to void your note(s) to give you your home free and clear and/or to award you relief and monetary damages.” In each case the notice contains the name of the company that currently holds the mortgage on the recipient’s home. While this may tend to provide credibility to the notice that information is easily obtained from public records. We believe these mailings are deceptive and recommend that anyone receiving similar mailings or offers not respond. There is real concern that consumers may be paying a significant amount of money for a service that may not stop a foreclosure and may not be resolved for many years. Some mass joinder marketers are taking as much as 80% of retainer fees charging them as marketing fees.
