I hired to build new back porch in premium treated wood. They used second grade wood that has plits through out almost all of the pieces of wood. The most important that is key to the structure was substantially split when they put the bolts in incorrectly. They didn't use wood screws but nails when they ran out of screws. All three of the Post have multiple failure points due to the large splits in the wood. We fear the porch will collapse in a short time. We are in our seventies and we would be severely hurt if it crashed. Please help us. Victor refused to inspect the work and cursed me and wouldn't return my messages left on his voicemail. After I kept calling he wasn't going to rebuilt even though I told him about the structural compromise . He said he put wood filler in the spring with no written guarantee he'd do anything. We' also discovered that the bannister at the basement moves and shakes easily and was not anchored! Resolution Sought Rebuild the porch with premium wood and use the proper screws and bolts to hold the structure up,

I requested that the owner waited till Spring. She told me she wanted me to tear out the porch I told her that was impossible I'm not going to .sometimes the wood does split but that is not of our control and it is in our agreement. If she could wait till Spring we will gladly take a look at the project and try to remediate any issues. But she was adamant that we tear the porch apart I told her absolutely not. I told her if there was any splits in the wood I would fill the wood but she refused and wanted the major post replaced. I cannot control wood because of nature. Also at that time lumber was in short demand because of the PANDEMIC. I would love to come out and take a look at these problems but please have her contact me in Springtime when it's around 60-70? so we can do this properly. And the rest of her wood can dry up because there may be more than one crack that's why we wanna wait.

Customer Rebuttal

He is lacking in integrity, morality and decency. The contractor's deception was in the fact that he didn't deliver the prime grade of wood that I specifically asked for, he used a low grade wood that had the splits in the wood when he brought it to my house. His workers are not skilled carpenters and used nails that were poorly put in and split the wood, when they should have used screws. The beam that is critical to the structural integrity was damaged because his workers didn't know how to screw in the bolt to the beam. They could have stopped then, but they built the porch anyway! As soon as he saw that picture he immediately started to fanatically say he was not going rebuild the porch! He had time to address the issue but he didn't last year before the cold weather! I called him and called him and left messages he refused to call me back. My request is reasonable, I want the structural beam replaced, I want the two post at the bottom of the stairs replaced which he agreed to. I want all the wood that is cracked to be filled properly and I want all the wood that is cracked to be filled properly and I want the porch to be protected as contracted to do with a clear solution.
