At checkout for my second course, the amount quoted was $17.00. The first charge hit my account that same day and came in at $26.90. Then, two days later a second charge came across for$29.90. When I called I was told that I opted for additional services. This happened with the company where I did my first course so I double and triple checked to make sure I had not opted for anything extra. My God! I'm filing for bankruptcy! I don't have extra money to throw away! Resolution Sought Refund my money and stop scamming vulnerable people who are already hurting financially.

We have reviewed the case submitted by customer regarding fees associated with her consumer bankruptcy personal financial management instructional course as required by U.S. federal law and the United States Depart of Justice's Executive Office for U.S. Trustees (EOUST) final rule. We understand the seriousness of Ms. Halstead's claims and wish to address each point comprehensively. First and foremost, it is important to clarify that the accusation of "scamming vulnerable people" is a serious allegation that implies criminal behavior. Therefore, in our strong opinion such claims fall outside the jurisdiction of the Business Consumer Alliance and are more appropriately addressed by law enforcement agencies. Scamming, as defined by law, involves intentional deception for personal gain or to damage another individual, which is a criminal matter. Additionally, the claim of "scamming vulnerable people" appears to be baseless, or frivolous and without supporting evidence. A baseless, or frivolous claim is one made without any substantive proof or detailed explanation. In this case, there is no evidence provided to substantiate the claim of intentional deceit or misconduct by our organization. Terms such as "scamming," "vulnerable," and "hurting financially" can be interpreted as derogatory, defamatory, and libelous, especially when unsubstantiated. Defamation involves making false statements about a person or organization that can harm their reputation. Given these considerations, we must inform you and the consumer that Access Counseling reserves the right to pursue legal action to protect itself from defamatory statements. Lastly, it is essential to note that this issue was resolved prior to its submission to BCA through a mutual settlement agreement that was satisfactory to both parties. Therefore, there was never any need for this claim since the consumer client received their desired resolution prior to the submission of this case. Thank you for your attention to this matter. I will rebut the issue that seemed to take up the bulk of their response, first. The claim I laid out in addition to other complaints that have been filed against this same company are more than enough proof that they are trying to take advantage of vulnerable people by charging excessively after quoting $17 - which, in my case, ended up overdrawing my account. Perhaps I could have used another word instead of the use of the word "scam" , as I did above. On to the "resolution" of my complaint. I filed this after speaking with the employee who answered my call. This was NOT a "mutual settlement agreement" and still, as of today, has not been satisfactorily resolved. What may be a pittance to the company makes the difference between eating and not. What has happened is that the company returned a bit over $16, which is a far cry, in my life, from the actual amount I was over charged.

When I submitted this complaint, the issue was not showing resolved on my end and I was showing another unauthorized charge to my account, aside from the $66.80. But yes, I did end up getting all the unauthorized charges refunded back. While I'm thankful that it was resolved, the concern is why were there unauthorized charges to begin with? I was told my card wasn't kept on file, but how was there additional charges made to that card, not even the same day, but 2 and 3 days after I paid the $24.95? That's a huge red flag. It should never have happened to me in the first place.
