The first thing you can see is, Ms. Strong did NOT hire us, nor did she pay us to connect this property to city sewer. The owner, Ms. Taylor did. When Ms. Taylor approved our estimate she approved all the disclosures as well. Please see below and highlighted parts of the estimate that I have attached for your review.
UTILITIES:
Action Pumping, Inc. or its crew is NOT responsible for any damage or breakage of unmarked in home Utilities/Gas/Electric/Sprinklers/Irrigation pipes/PVC Water Lines, etc., that may be in area of installation.
If you desire insurance to cover unmarked IN HOME utilities it will be a Non-Refundable additional fee of: $150.00 (Initial for approval):____________
With all HOME OWNERS we give them the option to add this insurance. The reason why he added this to all contracts as an option is because when we call in for DIG ALERT they do NOT mark for in home utilities (such as the water line that was hit). Since we are using heavy equipment to dig and not just shovels, we cannot be responsible for those utilities that get hit. The insurance covers ALL cost to fix any hit in home utilities. In this case, the home owner declined the insurance. At time of hitting water line, we would normally stop work and give home owner a call to let them know this needs to be fixed for an additional cost. Since we did not want the tenant, Amber Strong to go without water, we fixed the water line at no cost. I am not sure why she was having other plumbing issues such as hot water only and etc. since hitting the main waterline for the house does not effect the hot and cold water. There is no proof that we caused that issue.
When it comes to having to dig 160 foot trench and only having one connection point to connect to, we have to dig through bushes, plants and etc. to make it happen. We run as straight as we can to prevent any back up issues in the future. Our contract states:

Action comply' s with installation procedures enforced by the Town of Yucca Valley. Some case's can be invasive to your property. Landscaping including bushes, trees, branches, decorative rock, underlayment such as plastic/fabric, pavers and etc. can be lost and or not placed back the exact same way it was removed. Please understand we are not landscapers and your property was NOT bid to restore to 100%.
Excavations may look a different color because the dirt dug out (disturbed) wet. It will eventually dry out and blend to its natural color.
Clean out caps have to be visible (per town inspector) If you desire the cap to not be seen. We can furnish a concrete tra??c box with cast iron cover marked "sewer" for an additional sum of $90.00 per
cover will be flush with final grade.
The owner, Ms. Taylor was aware of this and signed our estimate for us to do that job. I don't have to explain why we had to cut bushes, roots and etc. to connect this property to a mandated sewer. Our contract covers all of that.
So with all that being said, we feel we are not in the wrong with this matter. If you would like to send me the plumbing bill, I can look it over and determine if we will help with that cost.
