Hired them to repair foundation wall, code enforcement failed it three times and they left our property looking like a pig sty. Told them we wanted our money back and they refused. Even code enforcement said they did not know what they were doing and would not follow any of his recommendations to correct the problems. They were paid in full and we still have no foundation wall and our home is considered unsafe to live in. My wife and I have health problems and we are living in a camper on our property. Every time they attempted to fix the problems, the same outcome, bowing wall, not level or straight. We want our money back so we can hire a real contractor, one that actually knows what they are doing. We paid $13,500 plus $1,000 for the post jacks which should have come from the amount we paid for the service. We agreed on $13,500 as the total cost and when they came with the contract to sign, they wanted us to pay for their taxes on the amount of the job. We paid for drainage to be done which never was, we paid for new soil to be brought in, never was. When we hired them, they assured us that they could do the job correctly, that never happened. I fired them after three months of the same outcome, shouty, insufficient work. They also charged us to take away all materials and did not do that either. There has to be close to 200 broken blocks and the ground still. This company should not be allowed to do business in any state let alone NY. Resolution Sought Pay us back the full amount we paid. If we could choose no stars, that still wouldn't do justice!!

Company Response

He hired us to build his wall about two months or so after it went down and he gave us a pity party because nobody else would touch it. We also told him he would need to get the jack stands so we can put the support beams back up and level them before we can start cleaning all the dirt and mud and broken wall out of the basement. The stands weren't included in our price he needed them asap. Upon cleaning the basement and cleaning out the footing we had noticed that the footing was not square and was not as thick as it was suppose to be for a footing. We told him it should be replaced and he told us just to work with it and do what we could to make the wall stable and that's what we did. Yes the first attempt was bad all around and when it failed we were right back there rebuilding it which we got it the best we could with the footing issue and yet it still failed again, so for the third time we got with the code enforcer and asked him what should we do being the footing was uneven which was making the wall uneven and all he said was to lay a run or two let it sit then put the next run on before you set them in place run a chalk line to level then cut all the block to Level with a demo saw. We had cut the blocks that had to be cut and did the third run. After doing the third run on the third attempt, we had went home and no sooner did we leave Mr Congdon texted me saying we didn't do any of the cutting we were suppose to like the code enforcer said and that it wasn't level and what not. Then said you are fired, don't come back on my property or I will have you arrested. He also states we used the wrong wire in which we didn't, we used masonry mesh wire for in between every other run and the wire he was talking about was wire that was in the ground long before we started the job. We didn't bring any other wire but what we used in the runs. As for the drain being put in at the base of the was that was going to be put in at the end before we filled the whole back in so being we were fired we did have a chance to put the drain in but we did have all the tubing and material to put it in which is still in his yard. As for us bring in fill, yes we were going to after we filled the massive hole back in with the dirt that was already there we were going to bring in fill to cover the top of the and make it like better then it did being the previous home owner used bad back fill when he did the wall. We were never suppose to get rid of all the old dirt and bring in truck loads of clean fill it was only suppose to be for the top fill. Mr Congdon also stated that we never got rid of the old broken blocks like we said we were going to but we were going to once we were finished with building the wall. Meanwhile the whole time we were building the wall Mr Congdon would wait till my partner and I left then he would either call or text us being very rude and argumentative over everything and anything. Before we would leave every night we would ask him to come out and have a look at the project and see what he thought and he would be the nicest guy about it but once we left he would call and have all kinds of complaints about everything. We had the agreement with the code enforcer that we would do a run or two during the week so this way he could check it on Sunday and make sure it's the way he wanted it. That was working just fine until Mr Congdon decided he did like that idea and started making trouble for us in being able to build the wall. He took his water lines away and stated that we would need to bring our own water to the site to mix the material to lay the block and we couldn't use his water anymore. Mr Congdon limited us on how much we could get done each time we went there to work because he was mad we weren't going to let him put windows in the wall while we were building it and we had told him they can be put in after the wall is built but he wasn't having it, then just started being rude and argumentative every time we left the site, he wouldn't come out of his camper to address any issues he had he would wait for us to leave for the night then start sending harassing text messages but yet we would still show up to do the job. The statements he has put upon our company for the most part are false we never damaged any of his property such as his home made smoker and for the ground being tore up that was from the equipment we had to rent such as the dingo and the excavator to dig out all the whole that was already there that made his basement wall collapse in the first place. As for anything else that he stated that we damaged is false As for all of this all I believe we are at fault for is not being able to get the wall as straight as it was suppose to be with the footing as bad as it was being Mr Congdon didn't want to have it replaced when it was brought to his attention. If Mr Congdon had wanted the footing replaced we would have done it for another small price but he refused to do anything with it.

Customer Rebuttal

I'll start by saying, Rick is lying, they did tell me about the footing and i asked why it wasn't fixed, they replied " its not in the contract". The scope of work was to repair the wall so if the footing had to be changed to do that than it should have been done. They never asked me if I wanted the footing fixed, they just kept making the excuse that the wall wasn't coming out straight or level because of the footing. I did hook up the water lines in reference to the bathroom sink as that is what they were for. The code enforcer did make a plan with them, and it involved cutting the blocks starting with the second course not the third, which didn't matter because they didn't cut any blocks to make it level. I'm not a block mason which is why i hired them for the work but needless to say, my wife and I did the work, the wall is straight and level, wow it can be done if you cared enough to do it right. They just didn't care is what it comes down to. As far as harassing text, i guess if a customer has concerns about the contractors work and confronts them, then yes i guess there was harassing text, grow up. However, Rick threatened me with bodily injury 3 times, that's harassment!!
