Ms. Ladmirault purchased a vehicle on April 24th, 2023. In accordance with the lemon law, The Arkansas New Motor Vehicle Quality Assurance Act, Act 297 of 1993, provides procedures for a consumer to receive a replacement vehicle, or full refund, for a new motor vehicle that cannot be brought into conformity with the warranty provided. The time period a new vehicle is covered under the Lemon Law ends 24 months after the date of the original delivery of the motor vehicle, or the first 24,000 miles whichever is the latter. The refund from the manufacturer shall be for the full purchase price (less an offset for use by the consumer determined by multiplying the purchase price by a fraction of the number of miles driven by the buyer divided by 120,000 miles), collateral charges such as sales taxes, title taxes, and extended warranties. When the sales tax is refunded to the consumer by the manufacturer, the manufacturer is then entitled to a refund from this office. The vehicle was sold to her, "as is, no dealer warranty." The customer signed the "as is" form and was told numerous times upon purchasing the vehicle that it was sold as is. Customer came into the dealership one week after purchasing the vehicle, with complaints about the brakes. Her complaint was taken very seriously, and her car was examined for the brake issue. The mechanic could find nothing wrong with the brakes. The customer was told that the vehicle was sold as is, but we would help her out since it was a drivability issue. that our dealership would put new brakes on the vehicle, free of charge.

Consumer states; I am not satisfied with the company's response prior to the purchase of the as is vehicle I asked specific questions on the car pertaining to all drivable parts I was assured that all drivable parts were in good condition however they were not I took it to them twice the second time they put front brakes and said it was okay it was not I ended up taking it to a Certified mechanic where it's still sits to this day getting worked on on all the drivable parts axle bearings front struts and to top it off it had no rear brakes whatsoeve. Tthe mechanic who is working on my car said I am lucky I did not get into a wreck and that it was an unsafe vehicle to drive. I also can obtain an itemized statement of all the drivable parts that have had to be replaced. Something needs to be done. I was given false information prior to the purchase of this as is car. If I had been given honest information I would not have purchased the car. It's not fair as a consumer that I am out this much money over dishonesty and that company's word prior to purchasing the vehicle as is.
