My husband and I hired Thomas Burton, owner of America Pro Services, LLC for several landscaping projects at our new home. We were referred by his son-in-law (who serviced our spa). Mr. Burton committed to three additional projects for $850 (we have text documentation of this). His employees showed up for one half day of work and started on two of the three projects. They did not finish the two projects and did not even begin work on the third project that was agreed upon. Before Mr. Burton left for the day, he requested money upfront to cover the cost of materials and then raised his price for the three projects from $850 to $1,000. I then paid him $750 upfront and agreed to pay the additional $250 upon completion of the three projects. We did not hear back from him for several days and then came to our home to tell us he had no intention of completing the work and never returned to finish any of the projects. Mr. Burton's employee (Ira) came by a few days later and informed us that Mr. Burton had cheated several other customers out of money paid upfront. We reached out to Mr. Burton (call and text) and asked him to return our money. He refused to respond for several days but is now sending harassing text messages accused us of treating him badly. He mentioned on several occasions that he was have money issues and has used his situation to justify not paying us back. Resolution Sought I would like Mr. Burton to return $500 for the projects that were not completed. I have had to pay another company $650 to complete the projects.

Though I believe some details I'm this complaint are inaccurate, I will Agree to repay $300. There was a lot of indecision and failed attempts to have customer tell me what to do with certain projects. This cost my company money on employees working and drive time. I tried communicating this part to them only to have no recognition of any wrongdoing on customers end. I also never stated I wouldn't work anymore, I returned a portion of the money to them temporarily and asked to finish work shortly there after. I was called same day and asked to return all money and I wasn't able to come back. I communicated the entire time about some work truck issues I was having and some delays.

I accept the offer the repay $300. How do we proceed from here? American Pro Services can pay via Venmo (they have my information) or mail a check to me. I would prefer to not have any further contact with them so I think either of these methods of payment would be the easiest way.
