For the past year we thought we were leasing apartment for one year at $1241 monthly; they say that we were on month to month supposed ly paying $1291. They never told us that we were paying the wrong amount . They just let the amount that we ( supposedly ) owe grow bigger and bigger along with late fees ! Now it's time to get a new lease and they already taken our $900 deposit from 2014 ,( when we moved in) without telling us; and just now on Friday May 20,22 demanded ( via email ) that we pay $600 , or they will take action ( eviction) also the next rent increase will be higher , because of what they think was our last year's monthly payment!! We want to lease again for $1290 which should be next for us . But they want $1340 per month for a year., Starting 7/1/ 22 . Is it legal to take our deposit and never tell us that we were paying the wrong amount , for the entire year ?? Please help ASAP , Resolution Sought We want our $1500 back and to pay $1290 per month for the next year ! It's only fair

Hi Loreva, thank you for bringing this to our attention. You sent your choice for change in lease terms back on time (March 2021) requesting to sign a 12m lease at the rate of $1241/month effective 6/1/21. I see no 12m lease contract was sent to you to electronically sign, and your monthly recurring charge was changed to the higher month to month renewal rate of $1291 on 6/1/21. You should have been charged $1241/mo (12 month rate) effective 6/1/21. Since 6/1/21, you have been paying $1241/mo for rent, with the exceptions of: 11/1/2021 you paid $1249, 12/24/2021 you paid $1233 for January 2022 rent, 2/1/2022 you paid $1249, 3/1/2022 you paid $1233, and 5/20/2022 you paid your full balance of $1891. All the while you were being charged $1291/mo, for a total of 13 months. We have credited your account the excess funds you were charged, this comes to $650. $1291-$1241=$50 $50*13months=$650. Regarding the $900 deposit that was added to your Appfolio ledger, along with your deposit payment from 2016. I believe that was a misunderstanding since it's at the top of your new ledger in Appfolio, it may seem like we charged you again however we were just transferring the deposit charge and payment from 2016 into our new system (Appfolio). Apologies for any confusion that may have caused. A delinquency violation letter was sent to you on 5/20/22, but we are not moving forward with the eviction due to the $650 being credited back to you for the mistake involving the wrong monthly rent rate charges. Your most recent rent increase notice was based on the increase from $1291/mo. You will be sent an adjusted rent increase notice effective 7/1/2022 for a 12 month lease at $1291/month and a $1340/month for a month to month lease. A note in your Appfolio account will be left explaining the adjustment.
