We signed a lease agreement with the owners of this company. We viewed the property 8/23, signed papers 9/3 and set a move in date of 9/15 which they were adamant about (we wanted 10/1) We go to unpack our belongings and they are painting the walls, there were no smoke detectors in the home, the keys given to us didnt work for either of the doors, there were nails and screws all of the floors. The home was filthy. We reached out several times about the issues and they said they would make things right. 9/17 things were still not up to code per our lease agreement and Florida state law (back door key still didn't lock) , the landlord called and became very aggressive over the phone and threatened to evict us. 9/18 we were attempting to clean the filthy home and found razor blades, little white baggies with white substance in it and a rolled up dollar bill. We contacted local authorities and an attorney and we were advised by both to vacate the premises for our safety. We requested a full refund which they still have not provided and after over 7 days the issues were still not fixed which by Florida state law they had that time alotted to do so. Very unprofessional company. Resolution Sought We would like them to provide a full refund of $3600 which they stated they would do but still have not done. By law we are entitled to a refund if the homeowners cannot provide a safe livable dwelling.

Company states: Per our Attorney's letter to the tenant's Attorney: Your letter dated 10/2/21 regarding above was received and reviewed along with the Lease, Florida Statutes and text correspondence between the parties. It is clear that statutory requirements regarding Tenant ability to terminate lease according to Fla. Stat, Ch. 83.51 and 83.56, have not been satisfied, nor did Tenants comply with Lease sections 27.C. and D. to terminate Lease. Landlord has materially complied with Fla. Stat. Ch. 83.51 and 83.56 promptly responding to Tenant repair requests, all of which were minor and promptly made. 10/2/21 letter contains exaggerated, false and self-serving Tenant statements and "proofs". There are many texts indicating prompt Landlord actions to remedy Tenant complaints and Tenant acceptance thereof. Tenants were back and forth several times on wanting to stay and wanting to leave. Tenants signed Early Termination Fee/Liquidated Damages Addendum agreeing to pay $2,800.00 for early termination. Landlord offered to refund tenant's money less rent, and costs incurred, as previously described in the amount of $1,800.00, but will not be taken advantage of, nor pressured by exaggerated, false and self-serving Tenant statements and threats to enforce in court. The Landlord relayed a sequence of events as listed in the Attorney's letter. In part, All requested repairs/concerns made by Tenants were dealt with in a timely manner. Tenants did not have the right to move out and expect to get all their money back. The random pieces of glass and other debris are a made-up attempt to get out of the lease and get their money back with a full refund. The Tenants also have legal obligations and had no right to up and move out while they knew we would be out of town. We have a signed statement from our handyman and a receipt from our cleaning lady. The Tenant was issued a Notification of Intent to Impose Claim Upon Security Deposit. Please advise if you wish to settle this amicably as described above, failing which Landlord will enforce its rights seeking damages and attorney's fees from Tenant.

Consumer states: Bluewater Turn Key LLC has NOT remedied the issue. They have not taken accountability and have failed to provide us a full refund of $3600 which they offered to provide (we have proof) Their allegations that we are at fault for breaching our lease agreement is NOT true due to the fact that we vacated from advice of Melbourne police and legal counsel. The fact there was obvious paraphernalia in the home and the threats Anthony Passarelli made to us over the phone we did not feel safe in the home and the home was absolutely filthy which by law landlords are set to provide us a safe livable dwelling. They have left us no choice but to take legal action.
