I purchased a 2009 Toyota Tacoma from Broadway Cars LLC located at 1972 Central Avenue Albany NY 12205 from Fred DeRise on February 3, 2024. He had the vehicle inspected at a local inspection station and the frame welded and patched without disclosing the fact that work was performed on the frame. I had the vehicle inspected at Empire Toyota in Oneonta NY on February 12. The technician there showed me multiple rotten spots on the frame and a leaf spring that was busted and held together with exhaust clamps. The rear left wheel cylinder was leaking, passenger windshield wiper blade was torn and the patch on the frame was not up to NYS inspection requirements and stated the vehicle is unfit for the road. All of these items are conditions for a fail on a NYS vehicle safety inspection. After driving the vehicle to the dealership to return the vehicle and get my money back on February 12 I offered to make an appointment with a shop local to him to have to looked over. I even took the vehicle to the inspection station that passed it and the safety inspector agreed that the vehicle should have failed. Fred wants me to leave the vehicle at his shop while I sit quietly in the corner while he conducts business and he will send a check to the bank in the mail. My banking institution clarified I may ask for a certified bank check when I drop off the truck and I relayed that information to Fred. He told me that's not how it works and he will see me in court to resolve this issue. Resolution Sought I want to return ownership of the vehicle back to the dealership and I want full reimbursement for the amount I paid for the vehicle, including the down payment.
