After a flood under the kitchen sink we hired this company to fix & extend 2 bedrooms, they hired contractors who installed the sink incorrectly & we flooded again. Months later the flooring kept popping up & there is mold in one of the bedrooms. All I want is to have this fixed, the common bathroom shower/tub can't be used because the water may damage the floor worse than what it is & the bedroom with mold can't be slept in because of this. Resolution Sought I just want this to be fixed, After all they got their $64k

Company Response

3/1/2022

We have gone back over our information of the remodel work and sink issue at the Sharp residence in Reklaw Tx. And are happy to explain our response. We did the original work on the house including remodeling work and addition to the structure. Just as the house was completed, there was an issue with the sink faucet in the Kitchen in which Bannister Plumbing installed. Once it was brought to our attention, we did go back in the fix the results of the leak from the faucet to the work we had just completed, cabinet work, flooring, painting, repairs, etc. All of which Bannister Plumbing covered under their insurance company. BUT, the funds to fix the repairs from Bannister Plumbing we funded directly to Mr. Sharp. So the check he got for $21,540.22 was all for the repairs resulting for the faucet leak. Per an email on Jan 28,2020 from Randall Cooper with Farmers Insurance, the payment was made to Mr. Sharp and we were to "You will need to contact Samuel Sharp for payment. Payments will be between you and Samuel Sharp". When we contacted Mr. Sharp about the funds back to Bannister or CCH to pay for all the repairs, it was explained to us by Mr. Sharp that all repairs was ours to correct and pay for and the resulting check to him for the $21,540.22 was his in which he spent on Service Master and ALE Solution. ALE being a company to arrange for temporary housing for them due to not being able to use their Kitchen sink. So to date CCH and Bannister plumbing has paid out of pocket for the repairs from the faucet leak, with no reimbursement from the insurance allocated funds in which Mr. Sharp availed himself to spend as he wanted without any communication to CCH or Bannister that he got the check or how he assumed he would be spending it. Also, to date, this is the first we have heard of any leak or issues since our last communications with Mr. Sharp in the first quarter of 2020, now being almost 2 years later.

Customer Rebuttal

When CCH came to work after the faucet leak there was never any mention of additional payment for rework. I was told "we will make it right and get things back to the way they were". During the entire rework process, mid-June 2019 till 3rd week in Aug, there was never a request for funds like during initial work. We hired CCH was for their reputation and they stood behind their work with warranty. It appeared they were standing behind their work. Even with other issues regarding a roof leak into the garage that was not completely fixed until October 2019, there was NEVER a mention of additional funds. CCH did not mention any money until my insurance began seeking reimbursement for their lose after it was proven the faucet was originally installed incorrectly. First I heard regarding any payment was late Dec. 2019, 4 months after repairs. As stated to CCH, most of the insurance was paid directly to Service Master and ALE Solutions. I didn't receive a check for $21,540.22. I also explained all of this in email to CCH in Jan. 2020. I never heard from them after and assumed they finally accepted the fact that this was warranty related work due to faulty installation of the faucet
