I'm seeking assistance in resolving a dispute with Capital Vacations Club, Inc. regarding a contract they have terminated while still attempting to collect payment. Capital Vacations has unilaterally revoked my "Member Beneficiary Rights," forfeited my accrued points, and recovered the underlying interest of the contract. Despite denying me a formal "Walk Away" agreement to close this matter permanently. The actions taken by Capital Vacations have rendered the contract legally frustrated and void. My complaint is based on the following points: 1. Failure of Consideration: Because Capital Vacations has revoked my membership and deleted my status as a beneficiary, there is no longer a "benefit of the bargain." 2. Unjust Enrichment: It is predatory and legally inconsistent to recover the product (the points and interest) while simultaneously demanding continued payment for that same product. 3. Unilateral Cancellation: Since the company has chosen to sever my rights, the contract should be considered canceled in its entirety, including any financial obligations. Resolution Sought Proposal-I will accept the permanent dissolution of my membership and the loss of all previous monies given, provided that Capital agrees to 1. The Mutual Release of liability, the account is marked "Closed/Settled" with waiver of alleged balances, maintenance fees, or late fees. 2. Cease/Desist-terminate all collection activity by Capital and any 3rd-party agencies. 3. Credit protection with no negative information given to Credit Bureaus. 4. We regret to learn the Gusman family’s experience with Capital Vacations did not meet their expectations. We are thankful for the opportunity to address and respond to the Gusman family’s complaint. On April 27, 2026, we made an effort to reach out to the Gusman family in order to address their concerns, however, we were unable to establish contact. Our records indicate we have previously communicated with the Gusman family to address their concerns and discuss with them the requirements for exiting their contract, which would include paying the loan in full, as well as any outstanding maintenance fees, Club Dues, Facility Fees, and the required exit fee. These requirements would need to be met in order to qualify for an ownership exit review. Also, we would like to clarify to the Gusman family that although their Member Beneficiary Rights have been suspended, they still have an outstanding loan balance which will continue to accrue interest as they remain liable for the debt. We encourage the Gusman family to contact our Financial Services Department to discuss potential resolutions or settlement options that may be available. I am requesting your help to terminate my contract with Capital Vacations because the service was fundamentally misrepresented. I was told my monthly payments would cover vacation lodging, but I am still charged additional fees every time I try to book a stay. This makes the entire purchase valueless. These ongoing costs have ruined my ability to travel. I used to take several vacations a year, but since signing this agreement on October 24th, I have not been able to go anywhere. My entire travel budget is now consumed by these monthly bills. Communication from the company was also unprofessional. It took until late February to receive the incentives I was promised at the point of sale. I had to repeatedly track down a representative named Jeremy for any information, only to find out the rewards required even more spending to use. I feel misled by this entire process and need your assistance to end this contract. Resolution Sought Contract cancellation

We regret to learn that the Doan family’s experience with Capital Vacations did not meet their expectations. We are thankful for the opportunity to address the concerns raised in the Doan family’s purchase; however, Capital Vacations maintains that the transaction was conducted in accordance with all applicable laws and company policies. On April 22, 2026, we attempted to reach the Doan family to address their concerns, however, we were unable to establish contact. Our records indicate we have attempted to contact the Doan family on several occasions in the hopes of providing the necessary assistance with their requests and inquiries, with each attempt being documented. It has been noted that in their complaint, the Doan family has requested their contract be cancelled. Currently, the Doan family has an outstanding loan balance as well as outstanding maintenance fees. These balances, along with the required exit fee, need to be satisfied prior to the Doan family exiting their active contract. If the Doan family is interested in a possible settlement, they may contact our Financial Services department at (833) 843-0301, Monday through Friday, from 8:00 a.m. to 5:00 p.m. [EST] for further information on their account. The initial complaint clearly outlines a case of fundamental misrepresentation, which renders the contract valueless to the consumer.Capital Vacations claims to have attempted contact on multiple occasions. However, these alleged attempts do not negate the core issue: I was misled at the point of sale regarding the financial reality of the contract. The promise of covering vacation lodging with the monthly payment was false, as demonstrated by the continued need for additional booking fees, which has rendered the ownership unusable and financially burdensome. Furthermore, the company's response fails to address the unprofessional communication and the difficulty in obtaining promised incentives, which were only received after repeated tracking down of a representative and found to require even more spending to be used—another clear element of misrepresentation. The company's focus on outstanding balances and an "exit fee" prior to cancellation is an attempt to enforce a contract based on a premise that was fundamentally misrepresent I am seeking contract cancellation based on a claim of fraud/misrepresentation, not simply a standard termination subject to exit fees.

Capital Vacations maintains its previous position that the Doan family’s transaction was completed in accordance with all applicable laws and company policies. Based on our review, we have found no violations related to the Capital Plus Purchase and Security Agreement executed by the Doan family, nor in their treatment as owners, that would justify cancellation of their legally binding contracts. As such, Capital Vacations is not obligated to terminate the contracts and has declined the request for cancellation. The Doan family currently has an outstanding loan balance and unpaid maintenance fees. In addition, any required exit fee would need to be satisfied before exiting the active contract. We encourage the Doan family to contact our Financial Services Department to discuss possible resolution or settlement options that may be available.
