We hired Capital Siding Inc to professionally install vinyl siding on our home. The job failed the building inspection due to water infiltration issues. The first attempt at a band aid repair using roof caulking in an area it would never be used, failed. We were told by Capital's siding installers the contractor didn't install the roof caulking on the vinyl siding properly. If the foam board under the siding was installed properly, this band aid caulking would not be needed or used in the first place. Their contractor created the problems. Resolution Sought After trying to work with Capital to rectify the situations we feel it has gone from bad to worse. First we would like the siding to be removed, the foam boards installed the same way they were before the contractor started the job and the siding reinstalled. Second we would like to have the aluminum work to be installed the way it was before the work was started as well. Last we would like to have the corner post reinstalled so they are plumb.

On 8/18/21 Customer signed a contract with Capitol Siding to install new vinyl siding and to cap 19 window casings only on their home at 238 oxford street North in Auburn Ma excluding vinyl siding on the inside of the front enclosed porch and porch window casings. 10/18/21 Project Started. As project was progressing smoothly the customer mentioned to the foreman on site that Capitol Siding was supposed to be siding the inside of front porch along with capping porch windows which was not part of the signed contract. Our Sales Manager, Ryan Sabatalo informed the customer that this wasn't part of the signed contract. However, wanting to make the customer happy Ryan decided to do additional capping of 11 window casings and interior of closed porch even though it was not part of the agreement. Customer was not asked to pay an additional cost to do so as a show of good faith on behalf of the company. On 11/5/21 Capitol Siding finished the project at 238 Oxford Street North in Auburn and per our contract agreement, we collected a check upon completion. Final inspection was then requested from the Auburn Building Department. On 11/17/21. Capitol Siding was informed by the Auburn Building inspector that we had a few punch list items that needed to be addressed at the Property address of 238 Oxford Street North in Auburn in order for him to sign off on permit. On Thursday 12/2/21 Capitol Siding performed all punch list items from the Building Inspector that could be completed except for the caulking around j channels that were recommended by the home owner but not standard practice for vinyl siding installation. This caulking could not be performed on that day when Capitol was on site due to cold weather conditions that would affect the curing of the application. Capitol Siding, however, did go back to finish the caulking work that the home owner requested and agreed upon with the building inspector. When on-site the homeowner started to argue with the crew and told them he did not want them to do what the building inspector wanted; that crew needs to do it his way. When the crew explained, they were going to perform the work as advised by the Building Inspector, the homeowner told the crew to get off the property. Capitol Siding called the building inspector to inform him of the work completed and to inform him of the homeowner denying the application of the caulking that was approved by the inspector and that Capitol Siding was told to leave property. Final inspection was performed by the Auburn Building inspector and was passed. Capitol siding was informed by the building inspector that the permit has been closed out and punch list was completed to his satisfaction per vinyl siding installation guidelines. Capitol Siding did the best to their ability to satisfy this customer. Work was performed and completed up to the standards of the Auburn Building Department. However, homeowner's irrational and combative attitude has broken down any further communications. We have been in business for over 70 yearsand I personally attempted to work with this homeowner and thought we came to a solution. The homeowner has tried to bully us and made threats to my company. I have also spoke to our attorney for slander and false statements by Mr. &Mrs. Herard. We try to please all our customers but I guess the saying you cannot please everyone is true. Sincerely, President

Customer Rebuttal

Last summer we reached out to Capital Siding Inc for a quote to have vinyl siding installed on our new addition and to replace the existing vinyl siding on the rest of the house as well, so it would all match. Within a few days, an older gentleman arrived to measure and quote the job. Mike met with him and they discussed the soffit material around the roof (white in color) It was in good condition. Mike asked for 2 quotes, 1 replacing the soffit and the other using the existing soffit materials. This was the only thing we discussed not replacing. We choose to use the existing soffit material. Before the job began, Mike reached out to request a meeting with the salesperson to go over the job in detail. On the day the job was expected to start, Mike took the day off of work and met with the contractors and Ryan from Capital. They went over all the work to be done, walking around the property, around the house. Several times Ryan pointed out to the contractor they were going to be doing all the metal work on all of the windows. Mike stood with them at the front of the house, in front of the porch and windows, and Ryan confirmed they were doing all of that. At that point Mike, Ryan and
