I contacted said realty company in regards to an apartment in Steubenville Ohio at 1327 Bellevue Blvd. I spoke with the employee on Friday in employee saying I qualify for the apartment after explaining all the details of my circumstances in per employee stating everything was all set and took my processing fee after acknowledging the issue with my criminal background he still took the money for the application fee and said they would hold the apartment until Monday today being Monday contacted the realty group and stated they will no longer be moving forward with the application after they took my money after they told me that my record would not be an issue and now are refusing to refund my three all application fee. He stated the application fee is nonrefundable but when I spoke with the employee prior to filling out the application all the details on my criminal background were available and employee was aware stated it would not be an issue that's why we proceeded with the application fee now that the Realty company change their mind after the application they refuse to refund my money. Now being only three days away from my move-in date they stated I no longer have the apartment available so now I have nowhere to go and I'm left homeless until I could find a situation due to their employee stating that the apartment would be available to me. Joseph was a 46 yr old prospect from CT with 2 dogs interested in our Belleview apartment. A Cedar One Team Member did the initial prescreening and scheduled his showing. Joseph mentioned a felony from 5 years ago involving a gun without a permit in his prescreening. Joseph spoke with a second Cedar One Team Member after that regarding his criminal history and she told him we would have to run the background for full determination. He was declined when his background check came back with zero credit and multiple felonies: • Assault Second Degree F – 9/2015 • Criminal Possession of Pistol Revolver F -- 6/2018 • Injury or Risk of Injury to Minor F – 11/2015 • Assault Second Degree F – 2/2015 • Criminal Possession of Pistol Revolver F – 7/2017 Application signed by him states: The applicant represents to the landlord that the application has been completed in full and all the information provided for herein is true, accurate, and complete to the best of the applicant's knowledge, and further, agrees that any such information that is not as represented, or if the application is incomplete, the applicant may, at the landlords sole discretion, be disqualified. Applicant hereby authorizes Cedar One Properties, LTD employees, agents, or representatives to verify all of the information in this application by making any and all inquiries necessary to verify the information provided herein and obtain credit reports on the above listed applicant and/or applicants. Cedar One Properties, LTD. may contact employers, landlords, neighbors, police, government agencies, and any and all other sources of information which may be deemed necessary and appropriate within our sole discretion. If applicant or applicant's spouse/roommate has given any false information, the Landlord is entitled to reject the application and retain all application fees as liquidated damages for Landlord's time and expenses in processing this application. Applicant shall give Landlord a nonrefundable application fee in the amount of $30.00 per adult. Landlord is not liable to the applicant, his heirs, executors, administrators, or assigns for any damages of any kind, actual or consequential by reason of the verification by the landlord of the information provided by the applicant, and applicant hereby releases the landlord, his agent, employees and representatives from any and all actions. The causes of action of any kind or nature that may arise by virtue of the execution or implementation of the agreement provided here in. The applicant, once approved, must obtain renters insurance. The applicant has 24 hours from the time of approval to fulfill the rental agreement by producing all monies required and signing all rental agreement papers. If applicant fails to perform within 24 hours of landlord's approval, applicant may be disqualified, and landlord may rent this home to the next qualified applicant. Once the applicant is approved and a Holding Deposit is paid, applicant has 72 hours to cancel before Holding Deposit is forfeited and becomes non-refundable. Cedar One Properties, LTD. required standards for qualifying to rent an available property are the following: • Your net monthly income must equal approximately 3 times or more the monthly rent • Credit history with no rental or large judgments • Be able to furnish acceptable proof of the required income • Good references, housekeeping, and property maintenance from previous landlords • Limit the number of occupants to 2 per bedroom • Compensating factors can include additional requirements, such as double deposit or rent paid in advance for applicants that fall short of the above criteria • No felonies and no misdemeanors involving sex, drugs, or violence. After being denied, his father called and spoke with one of our Team Members asking about co-signing for him and tried to plead his case. He was informed that we do not accept co-signers except in the case of college students.
