Central Plumbing and Drains installed a complete septic system at McKennan Road in Herkimer, NY beginning 7/15/2021. A receipt was received on 7/23/2021 in which it stated total amount of $24,000 and on that receipt it also stated he gave them deposit of cash for $12,000. The balance after they added tax was $14,100. The installation was never finished and on 7/17/2023 he received notice of Mechanics Lien for $38,500. On this Mechanics Lien, which must be filed within 90 days of completion, it stated Central Plumbing was last at the job site on 4/23/2023 which is a false statement. The Mechanics Lien is for more than twice what is owed although, he had to have family finish the job. I filed a complaint with the Attorney Generals Office on 10/31/2023 Intake # 1-743471892 and included copies of invoice #93 from Central Plumbing and Drains as well as copy of Mechanics Lien. I am the Power Of Attorney for my brother who suffered a major stroke and is currently in a Nursing Home. The other issue is a "Building Permit" was never taken out and Central Plumbing and Drains never submitted Engineering Drawings and Perk Test for new septic as required by NYS. My brother has to sell his house but realtor is having second thoughts with a septic system that is illegally installed. Resolution Sought Desired outcome, toss out the Mechanics Lien for $38,500 because it is not correct. I realize he needs to pay for what services were rendered, however, even the remaining $14,100 as stated on invoice is not accurate as they never completed the job.
