Company Response

2/21/2024

Company states; I offer this brief response to the recent concerns expressed by Mr. Hogue & I have no interest in further response. As I recall I was retained approx 2 yrs back by 3 very pleasant & delightful women, with family roots in TX, & their brother. A case investigative fee was paid to me gratis, by a friend of mine, Mr. Thorn of Thorn Construction & as I understand, Mr. Thorn was acquainted with the sisters who he was trying to help out. The parties requested that my firm investigate & review a probate, oil & gas lease matter involving their deceased grandparents from TX & dating back perhaps 30 or more yrs ago. The clients were concerned that perhaps their shares of estate trust proceeds may have been converted by another sibling & or the trust attorney & that substantial oil and gas lease money & other estate assets were at issue. Two of the sisters from TX provided me with 2 large boxes of docs, perhaps a few thousand pages pertaining to the matter. As I recall, most of the docs dated back to 30 or more years and were in a state of disorganization. It appeared also that TX attorneys had previously conducted legal review of this matter. My staff & I reviewed the docs & determined that there had been probate of the grandfather's estate many years back & so I portioned the TX court for an accounting & review of the matter. The TX court judge was very accommodating, even though I am not licensed to practice in TX. It was determined that there was no final accounting or order closing the estate, but the grandmother had indeed imitated the probate counsel. Our office did succeed in determining that there was some unclaimed oil & gas lease money available to the 3 sisters & Mr. Hogue from one or more oil & gas companies & some claims for unclaimed checks were processed for the benefit of Mr. Hogue & his sisters. When the checks came to my office, there were sent to Mr. Hogue & his sisters with request that each of them pay in return to my office our agreed 1/3 contingent fee for the recovery we made. The amounts recovered were modest, only a few hundred to each sibling, but nonetheless, due to the limited resources of the parties, they seemed initially thankful for the recovery made on their behalf. Mr. Hogue did not pay his legal fees associated with the last few checks recovered, but due to his financial condition, I am not concerned about payment to my office. The sisters all seemed understanding of this conclusion of our attorney- client relationship & requested that their docs be returned to them in TX. A disagreement arose between the siblings over who the docs should be returned to. Mr. Hogue came to my office to pick up the 2 boxes of client docs, but the 2 sisters in TX initially objected to turning the docs over to Mr. Hogue. I informed him of the dispute over who owned the docs, and this angered him, he left my office uttering profanity. Several days later, the dispute over the docs was resolved between the siblings & the 2 boxes of docs were released to Mr. Hogue by my legal assistant. Neither my legal assistant, nor I did something with this case, and I was not paid off, whatever that means. Davidson Law Center
