I hired them to consolidate debts and they said I had to pay a monthly payment, which they took a total of 3,400 from my Calstate credit union account. But they never did anything so I want my money back and they say I don't qualify for a refund and that they have a contract and I never signed anything it was all over the phone. Resolution Sought Get my money back.

Company states; The Client, Jose R Hernandez, enrolled in our Debt Settlement program on 05/02/2022. The reason for this was to get help from us with various debts of $31,000.00 approximately. As part of the agreement signed by the client on 04/29/2022 via DocuSign, (Copy of the frst page in Exhibit A), our service charges include fees that were clarifed both during our call and in the document. One of these fees consists of a 10% retainer fee, which covers work we perform throughout the program as we aim to reach the settlement goal. For Mr. Hernandez, this retainer fee is a total of $3,100.00, approximately. This settlement process relies on monthly payments from clients, who accumulate funds until we can o?er a settlement with their creditors. Mr. Hernandez accumulated $1.275,00 during the program through payments of $100.00 (Exhibit B). However, he did not make all the payments agreed upon. We did not receive payments for August 2023, February 2023, September 2022 (Due to chargeback by the client), and June 2022. The last payment was made on October 2023, and the client's account was placed in HOLD on January 2024 due to non-payment. The client did not respond to our calls during this period, until April 2024, when he requested to cancel the program. We explained the o?ers we had for his accounts, but he claimed that the service was not provided. Consequently, we proceed with the cancellation. Unfortunately, due to the 10% retainer fee (Based on the total balance) and the amount paid by the client, Mr. Hernandez does not qualify for a refund. Balance covers up to half of the retainer fee. I have proof of all the money they took out of my bank account that is more than $3000. I don't have any signed contract and they never communicated with my debtors and all my accounts went to collection. Then Mrs. Daniela Macedo called me saying that she could reach an agreement with one of my debtors but wanted me to deposit $5000 in the Well Fargo bank and that she would give me the account number. I didn't want them to continue taking money out of my account if they weren't doing anything, that's why I decided to cancel taking money out of my account. I just ask you to be honest.
