My company JMAP LLC entered into an agreement with Ecommerce Marketing Agency LLC ("EMA") on November 8, 2021 (the "Agreement"), whereby, among other things, Ecommerce Marketing Agency, LLC agreed to provide services to my client to set up and manage a retail store on Amazon.com. The performance of the contract has become impossible, and the consideration therefore completely failed, by reason of the fact that, even with the support of EMA, Amazon has deactivated my company's Amazon store due to violations of Amazon's drop shipping policy and Seller Code of Conduct committed by EMA. Since no object of the contract has been performed on EMA part, the contract must be terminated whit a refund of $30,000 fees paid to EMA. So far EMA did not refund the fees and ignored the call to do so. The company acted as a scam by never answering any kind of contact. Resolution Sought Refund the $30,000 fees as stipulated in the contract.
