My husband passed away in February of 2023. I want to know do the insurance company suppose to go by the cause of death on the death certificate when a person passes away when paying off on the policy. Family Benefit Life Insurance is going by the diagnosis that was put in my husband medical records in 2028 from his primary care doctor that we were never told about and wasn't being treated for. I had a meeting with the doctor and he said the diagnosis was of no clinical significance and he didn't have to be treated. I got these policies on 12/2021 and 12/2023. Resolution Sought I wanna make insurance pay off and not just give me what I put into i and go by the cause of death on death certificate

The two life insurance polices the complainant is referring to were applied for and issued in the state of Georgia. For life insurance policies issued in Georgia, rescission of an insurance policy for a misrepresentation does not require the misrepresentation to be tied to the cause of death. The insured passed away during the contestability period of the policies. Medical records received document that misrepresentation of the insured's health were not disclosed at the time when either policy was issued. As stated in the applications, "any material misrepresentation or misstatement contained herein may render any policy issued as a result of this application void from the its inception". Family benefits life insurance company adjudicated the policies as rescindable and void from inception. The misrepresentations on these application were material to the company's acceptance of the risk. If the true facts had been disclosed on the application, the company would not have accepted the risk and would not have issued policies.
