I purchased a dirt bike in Brecksville, Ohio. I was given a bill of sale. When I went to get the title with my BOS and vin I learned there was a lien on the dirt bike from the original owner, not the seller. I contacted the bank/lien holder and tried working with them for months with no resolution. The seller (after the bank coerced/gave me an ultimatum to file a small claims suit (and helped me in doing so by finding out where to file and what to write in my complaint) at Garfield Heights Municipal Court against the seller that I eventually motioned to have dismissed) offered the bank $3500 to settle. I found a previous case from 2022 where the bank had tried to sue the original owner. At that time the loan amount was $2k (plus interest and late fees) and the bank valued the dirt bike at $3565. The $3500 offer from the seller was $1500 more then the loan amount that was due in 2022 (it's now apx $4700) and $65 less then what the bank valued the bike to be at 2 years ago. The bank refused the offer. The bank stated I could accept the $3500, they would give me a $400 credit and then I could pay the remaining $7xx. After doing some research I did not respond to that email and the seller was no longer willing to pay the $3500 after the bank refused the offer. I have 400+ pages of documentation/evidence (texts, emails, voicemails) of debt collection (a debt that's not even mine) laws that the bank violated. Resolution Sought Release the lien and reimburse me for my cost of action.
