My business did work for this company as a subcontractor in 2023 where they were holding 20 retainer from each check until $2500. We had to accept that otherwise we couldn't work. This year of 2024 I stop the construction business due personal problems and advise them by email. Now I asked for my retainer back they said I have to wait 2years in case they have any repairs. From my knowledge is illegal to retain money from subcontractors as we pay taxes for them and provide insurance so I need help getting that money back and avoid they doing that to other people. All subcontractor signs a contract upon becoming a subcontractor of Flooring Plus of SC, Inc. that clearly stated our payment and retainage process on page 1 of contract: 3. Payment and Retainage Subject to the retainage and other provisions hereinafter set forth and further subject to additions and deduction by written change order, Flooring and Plus shall pay Contractor for performance of the Work, a liquidated sum which shall be calculated and agreed to by the Parties in each individual Work Order and shall be paid to the Contractor at the end of the business week following the completion of the Work Order. Beginning with each Work order entered into pursuant to the terms of this Contract, Flooring Plus will deduct Ten (10%) percent of the total amount of each Work Order as retainage, until such time as the total retainage has accrued for the Contractor, depending on the number of installation crews executing work by Contractor under this Contract as follows: Number of crews working for Contractor: Amount of Total Retainage: 1st Crew $2,500.00 2nd Crew $2,000.00 3rd and 4th Crew $1,500.00 In the event any completed Work Order requires repairs or corrections, Contractor shall promptly make such repairs or corrections upon being notified. If any repairs or corrections to any completed Work Order remain outstanding as of the date payment is due Contractor, Flooring Plus may withhold all or a portion of the payment to Contractor until such time as the repairs or corrections are completed. In the event this Contract is terminated for any reason, Flooring Plus may use the retainage on account for Contractor to defray the costs of repairing or correcting any Work Order not completed by Contract while this Contract was in effect. At the end of twenty-four (24) months after the termination of this Contract, Flooring Plus shall return the balance of any retainage on account for Contractor. Flooring Plus of SC Inc will return any funds remaining in Quality First Flooring's retainage account on 1/17/2026 (24 months form final paycheck.)

It doesn’t say in the contract hold of retainer for 2 years up termination of work with your company so that means I am entitled to get the $2500 back .

The complaint says we owe this subcontractor $25,000.00 which is incorrect. We are only holding $2500.00 in their retainer account. The subcontractor will receive any remaining funds in their account after 2 years of termination date. (24 months) which is stated clearly in contract. Thank you.
