On March 1 2022 I requested a free home estimate on gutters. Sales person was very high pressure and talked me into a sale of gutters tried to say no but he kept pressing me. I did sign a sale but did not realize it was binding. So on March 31 2022 someone came to my home without my knowledge started putting new cutters up on my house. A week prior to this I sent a letter to cancel service but they proceeded with the job I was also told that they did not finish the job at the time I told them to leave because I cancelled. On August 5 2022 I get a collection notice . Now from march till now I never received any bills or notices from them. Living in social security I can't afford this please notify them of that complaint they should not being doing this . I cancelled the service prior to them coming out and they still came out to do the work without notice. Resolution Sought Take this away from collections and the acknowledge the cancellation and apologize.

First and foremost, I take issue with almost everything Ms. Schaeffer details in her complaint. The only thing I do not dispute is she sent our installers away. "The salesperson was very high pressure." This one always makes me scratch my head. This was your home, you made the appointment, etc. If at any time you asked our Representative to leave or said no to the product he would have left. You were in control the whole time. Not only did she not say no, but she also signed a binding agreement. I feel sure this is not the first contract Ms. Schaeffer has signed. "I did not realize it was binding." "A week prior I sent a letter to cancel." Both statements are blatant falsehoods. I have attached the binding contract that she signed on March 07, 2022, with the approximate start and completion date on it. If the Ms. Schaeffer as she claims, did not realize it was a binding agreement, why did she feel it necessary to cancel by mail per line E of her signed contract as she states? We have never received an email or letter from Ms. Schaeffer stating she wanted to cancel the contract. If again, as she stated she sent one I would ask her to produce the email with the date of March 8 – 10th of 2022 on it. Line D, right above Line E states that if she cancels the contract prior to installation after the 3 days she does agree to pay 25% of the contract price or the cost of material whichever is greater. The last part of Line H states, IN WITNESS WHREOF, the Owner and Contractor have caused these present to be singed this: with Ms. Schaeffer and the Representatives signature dated March 7, 2022. We have given Ms. Schaeffer MANY opportunities to settle this amicably, including offering her financing and a payment plan. She has been rude, belligerent, and balked at every effort we have made. She was belligerent to our installers the day of without provocation. Ms. Schaeffer allowed our installers to finish approximately 50% of the installation before she stopped them and sent them away. I have attached the before pictures as well. Ms. Schaeffer had part of her gutter hanging off that she allowed us to fix. They were simply doing the job they were assigned. At this point we have exhausted our patience with her and will pursue all means necessary to recover what we have lost in material and time.

This company preys on consumers. High pressure sales tactics. I am a widow and living on social security benefits. Collection s should not be allowed if a person lives on social security not even mine my kids. I need help to get this company off my back they are calling random people with same last name threatened me. I said no to there service but they are binding did not even finish the job I need help. I want them to back off and I want this cost to be overthrown. I cant afford it I told salesman no but unfortunately I just signed to get him to leave he was at my home for 2 hours. He was very high pressed sales. I am a widow and have not income but they company is threatening me.

My final response is this... Her age never became a factor until she needed to pay. We fixed her gutter that was hanging off her house. She ALLOWED our installers to work on her home and when the "Eyesore" as she called it the day of was fixed she told them to leave. We have simply asked for proof that she canceled the job, which she has never provided because she is not telling the truth. She has stolen our materials , our time and stolen from the installers that she allowed to work on her home. NOONE has been paid on this because she has not paid her bill. If she as a senior citizen is now claiming she should not be held accountable for her debt then she should have a POA for her finances put in place. Our installers, reps and office staff have families as well, they are on a budget as well. They have bills to pay as well. This is a ridiculous argument. We have NEVER threatened this customer. We have held her to a contract that she signed, she was told the presentation would take 45 min to an hour she agreed. ALL of our calls are recorded. We will pursue this with all the legal ability we can. Now she is attacking our character and we will pursue for defamation.
