I have a signed Contract to bill an ADU 2 bedrooms 2 1/2 bathrooms. They started February 14, 2023 to be completed June 14, 2023 have been back since October 2023. . I received a letter today indicating their intent to complete my project, however, if I take any actions it will prolong them to complete. Basically, my progress payments were used elsewhere. The letter doesn't indicate what day they'll be returning. I just want my project completed its going on a year. Please assist. Resolution Sought To provide a date of completion my property is in a disarray.

As of Nov.21,2023 Forty General Builders Lic. #1064226, Owner Jose Cuarenta has failed to finish the contracted work (Garage Conversion to ADU) at 825 E. 99th, L.A. Ca 90002. We have paid them 1, 2, 3, up to the 4th progress payment of $27,500.00. Total $130,000. They have not finished the work as agreed to by the contract. We have contacted them time after time, they have given us un-fulfilled promised to finish...We sent Forty General Building, Inc. owners, Jose Cuarenta, and Jesus Cuarenta in written detail "Demand for Furnishment and Delivery of all Materials and Labor work detail pertaining to the completion fulfillment of the ADU Conversion Construction and that the work to be performed in accordance with the professional code, and complete all unfinished details to complete the work they contracted to perform and we paid them to finish the ADU Garage Conversion Construction. All to be provided immediately, and without further delay. As of this Complaint Filing January 10, 2024 Forty General Building has not completed the work and they are not returning our text messages, or phone calls. As of this Complaint the agreed upon completion date is 5 months behind schedule. Forty General Building Inc. Owners and it's Agent has not communicated to us their immediate intentions and have failed to finish the construction project as described herein, within the past 3 months they have given us many conflicting dates for expected completion and are not acting in good faith Resolution Sought Either Refund to us the 4th Progress Payment of $27,500.00 or Honor the Construction Contract Immediately and perform and complete work deliver materials and labor and provide to us the Turn-key ready ADU as described in our agreed upon contract.

Per consumer: We the owners have reached a tentative agreement with the company (Forty General Building, Inc.) In an attempt to resolve our complaint. By no means is our complaint resolved. However, We the owners have come to a good faith agreement with (Forty General Building, Inc.) As of 01/16/2024 the company has commenced work on our project. If Forty General Building, Inc. abides by our agreement without any further delays, our project should complete within 30 calendar days of this response.
