This shall serve as the response of MGA Insurance Company, Inc. ("GAINSCO"), to the Consumer request for assistance dated January 30, 2024.
Mr. White purchased a policy with GAINSCO through Stephens Insurance & Financial Services Inc. agency, with an effective date of June 1, 2022. The policy was originally bound with two vehicles, with BI/PD Liability, Uninsured Motorist, Medical Payments, and Rental Reimbursement coverage for each vehicle. At no point were Collision or Comprehensive coverages included on the policy, or the premiums paid by Mr. White. On July 21, 2023, a change was made to the policy through Mr. White's agent to remove the 1997 Chevrolet Suburban from the policy. The Rental Reimbursement coverage limit for the 2004 Mercedes C Class was also changed from 40/1200 to 30/900 reimbursement limits. On July 26, 2023, the agent contacted GAINSCO to confirm the changes had been made on July 21, 2023. An amended Declarations Page was generated and mailed to Mr. White, indicating the changes to the policy. The policy was renewed on December 1, 2023, and the renewal Declarations Page matched the policy changes made in July 2023.
On January 4, 2024, Mr. White called GAINSCO Customer Service to discuss the changes to his policy. The GAINSCO representative advised Mr. White that his policy documents were not signed, but when a change is made to a policy, the electronic documents are not required to be uploaded to the policy to complete the change. GAINSCO does suggest for the agent to send the email confirmation amendment to the insured for signature.
We reached out to the Stephens Insurance agency, and they advised the agent who handled the policy change on Mr. White's policy no longer works at the agency. They were unable to provide any additional information regarding the July 2023 policy changes. White is currently paying premiums for the coverages found on his renewal Declarations Page. If Mr. White wishes to add coverage back to his policy, he should contact his agent to do so.
