I was asked by Ana Colon and Laura segal to withdraw my complaint about my unit at Glenside Terrace that I have only lived in for 2 weeks at the time and Laura would refund my security deposit and last month rent. I withdrew complaint and asked for a letter stating that I would be let out of my lease as promised and have been ignored. Bad enough I have been back and forth to hospital and dr appts due to mold exposure and filth from the apartment. Resolution Sought Honor their word and refund me my money when I give them the keys and let me out of my lease.

On 11/18/21 - I pd. a security deposit of $1495 via cashier's check to Ambler Crossing (owned by Goldcrest Properties in Lakewood, NJ) confirming my upcoming move to unit I2 on 12/15/21. I was told by their representative Alisha that I would be sent a lease the following day outlining the terms and conditions of the rental agreement. After repeated attempts and correspondence with several individuals associated with the property to get a copy of the lease agreement I never received it (so I never signed a lease agreement). Since I never received the agreement, on 12/6/21, I requested a refund of my security deposit from Laura Segal at Goldcrest Properties who said that I could not be sent the actual lease with my name on it due to company policy and that they would send me a blank lease to review the terms and conditions - again I received nothing from them. I was then told by Laura Segal to contact Ambler Crossing directly for refund of my deposit, who asked that I send a formal request via email with I did on 12/8/21. On 12/9/21 it was confirmed that they received my request, however nothing has been resolved. According to Laura Segal of Goldcrest Properties (which I found purchased Ambler Crossing in July of 2021), who stated that when I gave them the security deposit I signed a document stating that it was non-refundable under any circumstances. She said I backed out of taking the unit, which was not true - I didn't take the unit because they never sent the lease. Resolution Sought I would like to get my security deposit of $1495 refunded to me. Thank you for your help.

Our office received the below letter from you regarding a prospect of ours, he applied for an apartment and was approved, he then paid his security deposit to secure the unit and for us to hold for the lease term. He signed our approval letter that clearly states the Security deposit is non-refundable. Attached is the letter we received and the signed letter. Thanks!

The security deposit was paid in good faith with the understanding that a lease would be provided, which under Pennsylvania Landlord-Tenant law states that rental agreements are required for tenancies that are 12 months or longer in PA, in this case the rental period was to be a year. I made multiple attempts to get a copy of the lease from Goldcrest Properties and Ambler Crossing and each time was told it would be sent, but it never was. Therefore I asked for a refund of my security deposit, because I was never furnished with a copy of the lease. Lease provisions in the state of PA state that both the landlord and tenants names be on the lease, the conditions of occupancy, description of the leased premises, term of the lease, amount of rent, when rent is due, etc. Under Pennsylvania law, a landlord may only withhold a tenant's security deposit if there is damage, unpaid rent, or breach of lease - since none of these conditions applied because there was no lease (despite my attempts to get one), my deposit should be refunded. I am trying to resolve this peacefully, but be assured that if I need to take legal action, I will not hesitate.
