I had a loan with Home Acceptance Corporation I was having money issues I had spoken with a guy from there office to get a extension the guy won't not give me one Home Acceptance was harassing me over the phone and sending people to look for me at my house i also made a settlement offer by email and I never got a response from them at all and now they are reporting negative to my credit report I had to change my phone number because the harassment would it stop by them and they send me emails that I have to provide all the information they were asking me because I gave them that right when I sign the agreement . Resolution Sought I would like for Home Acceptance Corporation to remove the account from my credit report because all of the harassment they were doing to me and the stress I want through if they would of accept the settlement offer I made to them I would never had to file for bankruptcy in the first place.

Mr. Hernandez applied for a loan with our company. He explained he had a family emergency and wanted a personal loan. He stated he had a good paying, steady job. His credit report showed a few trade lines in good standing. He filled out and signed the credit application and all the loan agreements. On September 29, 2021 we took a chance on him and made him a personal loan. His first payment was due on October 29, 2021. The personal check he remitted for the first payment came back NSF (non sufficient funds). We attempted to reach him by telephone. He changed his phone number. He never notified us of his new phone number or new address as he promised in writing he would. We sent billing statements and reminder notices to him. Contrary to his statement, not once did he contact us to make a payment or make payment arrangements. He never made one single payment on the money he borrowed from our company. In fact, the only contact we were able to make was through references he submitted in support of his loan request. We were forced to attempt to personally find him. When we made contact, in January of 2022, 3 months after he took the money and never made one payment or even a partial payment, we received notice he had filed a bankruptcy petition. Mr. Hernandez is obviously familiar with evaluating his own credit report. We reported that he made zero payments on the money he borrowed from us and then filed bankruptcy to discharge the unpaid debt. He should not be surprised that other creditors may interpret that negatively. The attempts we made to restructure his loan, to make partial payments or get a payment deferral were met with silence. After Mr. Hernandez made a post similar to this post on another site, we invited him to make payments on his loan, pay the loan off, or contact us to come to some other settlement. Again, there was no response other than his present post. Clearly Mr. Hernandez is trying to use social media to escape the reporting to the credit bureaus of the choice he made to pay not a single cent toward the money he borrowed from us - perhaps so he can repeat his scheme with another creditor.

Contrary to what Mr. Hernandez states, the only offer he made was in a letter he mailed via U.S. Mail after he posted his comment. Prior to his latest online post, we received only two emails from him. The content of each was, “Hello my name is Juan Hernandez Ortega home acceptance corporation send me a email about my account please contact LAW Office OF Raymond Perez at (562) 862 - 9944 they are the ones representing me .” Each email was sent on January 11, 2022. The next notice we received was a Bankruptcy filing. He never paid a dime. He never attempted or offered to pay one cent before then. If he sincerely wishes to settle his debt with us, as we have made clear many times, we are certainly willing to discuss the matter with him. With respect to the offer received on 11/02/2022, we have informed Mr. Hernandez that if he makes payments on his account, we will report any payments he makes to the credit bureaus and if he pays off his account we will report his account as paid. We also informed him we will not participate in reporting false information to the credit bureaus as we feel his offer appears to suggest.
