Customer executed a contract that incorporates the business's terms and conditions of sale (the "T&Cs"). Customer cancelled the order. Pursuant to the agreed-the T&Cs, Customer is responsible for Termination Charges, as defined in the T&Cs.

I never cancelled the order, they sent us the wrong materials and never confirmed with me prior to sending items. I have contacted them on many occasions and have been told in short that there is nothing they can do, I have to eat the almost 10k cost of wrong materials sent due to their lack of customer service. I still have all the materials that they sent us, I just want them to either return my funds or give me the correct materials. Also I had ordered doors for my client, paid out of pocket, Janus sent them and they were rejected because the color was wrong. We had even sent pictures so this is just another example of their mistakes. If they cannot honor our simple request, we will be forced to pursue legal action.

Customer received a purchase order for the materials, executed said purchase order, and confirmed the color in said purchase . In accordance with Customer's requests and confirmations, Company manufactured and shipped the materials. Customer received and still retains said materials. Company is not responsible for Customer's mistake in ordering the wrong colored doors.
