I am insured and was in a car accident. Liability is in dispute and JNA is sending me threatening letters to collect on the other vehicle owner's repairs, even though I would not be responsible for this beyond my deductible regardless of liability as I was and still am insured. Resolution Sought Not collect a debt from the wrong party. Cease harassment of me, and deal directly with the insurance agencies involved.

I called and left 3 messages before a very rude agent Andrew Montgomery returned my call. I informed him I was not the driver and the witnesses stated the other car was at fault he said I owned the car was responsible anyway. I asked to go to court to fight the case he yelled at me and hung up. Resolution Sought For Geico to prove my vehicle was at fault and come to an agreement, I am a single mother of 4 and cannot afford this on a single income.

Our office, Jonathan Neil & Associates (JNA), represents Geico Indemnity Ins Co (Geico) for matter of Subrogation and Litigation; and for those stated purposes we retain the right to speak on their behalf. Specifically, in our capacity as TPA (Third Party Administrator) our primary role is to factually prove or disprove if a vehicle involved in an automobile accident maintained valid Liability Automobile Insurance, pursuant to Arizona Revised Statute 28-4009. Upon discovery of any Uninsured Party or Vehicle, pursuant to all available guidelines, we are to immediately report them to the State of Arizona D.O.T. This matter originated from an automobile accident that occurred on March 24, 2022. This is solely a vehicle versus vehicle loss. In question is a 2004 Mercury Mountaineer bearing Arizona Plate: EPA7CZA, which at the time was being operated by Fernando and registered to Claimant Delphina; the other vehicle involved was owned and operated by SOUTHARD, which was insured by Geico Indemnity Ins Co. Both parties had exchanged information at the scene of the accident. On or about March 25, 2022, our client, Geico, received correspondence from AAA Insurance, which indicated that the Automobile Policy presented at the scene of the accident was not valid for Fernando. As the Operator and Vehicle were Uninsured, our office is tasked with determining if potentially there was another Automobile Policy that will provide valid coverage for Fernando. Our notice sent to both parties Fernando and Delphina is a request for valid insurance coverage for the aforementioned automobile accident. In our investigation we have learned that this is a matter of Negligent Entrustment, meaning that the Registered Owner, knowing Fernando was not a listed driver on the Automobile Policy, still permitted him to operate the Claimant Vehicle. As no information, other than the No Coverage Letter from AAA Insurance, has been forth coming from either party, our office has no alternative but to report this to the Arizona D.O.T. as an Uninsured Operator and Uninsured Vehicle, for failing to comply with Arizona Revised Statute 28-4009. Our office will be submitting notice to the State of Arizona D.O.T. and closing the file back to Geico Indemnity. No further action will be taken by our office after this submission.
