My brother and I went to Texas to purchase a 2016 Nissan Maxima Platinum coming from Louisiana. They stated that they were a used car lot and that I would be able to put down on the vehicle and make payments on the vehicle to pay off the rest and that nothing was wrong with the vehicle. When I got there I test drove the vehicle in the parking lot and I let them know my concerns about the vehicle although I signed the "as is" paperwork they did agree to me being able to bring the vehicle back at any time if I had any issues with the vehicle. I got to Louisiana and started having issues with the vehicle so I texted the owner and let him know. He did not want to uphold to his agreement to allowing me to bring the vehicle back within a reasonable time frame so that I would be able to get my money back. I was able to confirm that the transmission did go out in the vehicle as well as other minor issues with it so I informed the owner of this on July 11, 2024 and he is wanting me to pay the vehicle off so I'm his words "so he can get the vehicle off of his back" The vehicle has not been operable since I purchased the vehicle and it has taken me months to get to thins point to even know what was going on with it due to a major surgery that I had that the owners are and were aware of being they were patient on payments. Resolution Sought I would like for them to come and get the vehicle and pay me the 6,800 dollars that I have given them. That's not even including the money that I had to pay to put it into the shop to confirm my findings with the vehicle.

Company Response

Company states; The complaint from Abriana Bennett is not a reasonable complaint as we have assisted her in multiple ways. First, the vehicle was examined and driven prior to her purchasing the vehicle. Secondly, the vehicle was sold as a cash deal in which she was not able to pay all of it at once in which we gave her 60 days to pay the rest of the $2300 balance that was remaining just to help her out, in which she did not full fill . She paid $1300 out of the $2300, so her remaining balance is currently $1000. Abriana asked for additional discount after speaking with me and I went down to $700, then she asked for an additional discount and I went down to $300. In all situations, Abriana agreed to these rerms of discounts but she never paid the $700 or the $300 in this case. Abriana had the vehicle for months and have driven it back to the state she lived in and used it on multiple occasion, and agreed to pay her balance after her surgery which I have been patiently waiting, but she never full filled her balance. The vehicle was driven and sold as is.

This is not accurate due to the issues that was wrong with the vehicle. I asked before I left when purchasing the vehicle if I could bring it back. You agreed and then when I told you the next day about the issues with the vehicle you then started going back on your word. I asked you for my money back and for you to come and get the vehicle. The owner was the one giving the discounts due to my expressing the fact that I will be out of 6000 dollars getting the transmission fixed on the vehicle . The way the vehicle was cutting off in traffic, I just thank god that my child and I didn’t get hurt because this could have went really bad with us getting hurt in the vehicle. It doesn’t seem as if the owner cares about safety of the consumers as long as he is willing to make the sale. I went ahead and paid the $200 as promised although the owner went down to $150 so that I am able to get my title for this vehicle so that I am able to get rid of the car. I have documentation and recordings of this also.
