Living Southern sold me a new mobile home June 2020. They have Failed to make repairs or replace the home. I was sold a home with carpet after I specifically stated " 5 times-No Carpeting" The Home was delivered damaged interior and exterior. I phoned,emailed and text for a year-they refused to make repairs. I was Roped into taking the home with carpeting not knowing Winston and John set me with a LEMON Defective Home. The home never should have passed Inspection, the red plate on the home "Manufacture Certified the home was Inspected and Constructed within Federal Laws etc. It was NOT! I have been told by Living Southern, Tru, Clayton Homes and Tru's attorney: "The home is LIVABLE" "All repairs were completed". NOT TRUE! I emailed,phoned, a year of text messages and Nothing has been done! DISCRIMINATION-FRAUD-Taken ADVANTAGE of. Broken Promises made by all. Water/Mold in the ducts since July 2020. Wiring problems since June 2020. Furnace was serviced 5 times within a year because of : Coil kept freezing up since July 2020,bad fuse,pipes leaking,copper line replaced,defective heating cable,no proper filter placement to hold filter in place,no silver lining on one side unit,no proper drainage,fan had been rewired,coil was not fastened down or installed properly for over a year. The control panel isn't flush in the wall,bad heating heating fuse,loose wires. Plumbing leaks in all bathrooms/kitchen. Damaged receptacles installed. They all say Hurricane Sally caused damage Resolution Sought I want a new house with out carpeting as promised in May 2020. Or All repairs done by an honest repairman- NOT Cimaaron! The home was delivered trashed and filthy! I was told "It's common for Black Mold to grow in the home/ it's Livable" by a bunch of men who are living comfortable in their homes. 3 winters I have frozen because the house is not sealed/weatherized . I use my oven and space heaters to warm home. Give me money to get repairs done.

Please be advised that some of the complaints set forth in her description are new complaints for which Living Southern has had no knowledge. We reviewed all of the closing documentation and there is no indication that Ms. Barnett did not want carpet in her home as noted on the Purchase Agreement. She has made numerous service requests since her purchase and our client has gone to her home on multiple occasions to address all of her concerns. The Florida Highway Safety & Motor Vehicles division inspected the home and sent the manufacturer, Tru Homes, an investigation report on May 3, 2021, which was forwarded to Living Southern. Once our client received this list, Living Southern worked with the manufacturer's representative to complete every item on the list. Importantly, a tree fell on this home during Hurricane Sally which caused extensive damage to the home. We can provide pictures for your review if necessary. Also, it needs to be brought to your attention that Ms. Barnett previously had numerous attorneys. The attached letters (provided to BCA for review) and emails prove that any additional items on Plaintiff's complaint list have been addressed and repaired before Elizabeth Citrin, Esq. withdrew from her representation of Ms. Barnett ("Exhibit C"). Ms. Barnett then retained new counsel. The manufacturer was also represented by counsel (Daniel Weber) and the lawyers for all parties agreed to do a joint inspection of the home for settlement purposes only. The inspection was scheduled, but Claimant's counsel, Tom Shahady, notified all counsel of record that he resigned from any representation of Ms. Barnett before any inspection occurred. The emails setting forth this correspondence is attached hereto for your review. As you can see, Living Southern has done everything possible to satisfy any complaints of Ms. Barnett, but Living Southern offers no warranties on this home and it did not manufacture this home. It is only the retailer of the subject mobile home. Claimant was also well aware that there were possible defects related to the home, and executed documents acknowledging it at the time of her purchase. Finally, any complaints filed by Angela Barnett are improper. She executed an Agreement for Binding Arbitration to resolve any and all "claims, disputes and controversies between Purchaser and Retailer arising out of or relating in any way to the sale (and the negotiations leading up to the sale), purchase or occupancy of the home or to any goods, fixtures, products offered and sold in connection with this transaction." ("Exhibit G"). She also asserts claims for fraud against the retailer in her Complaint, but all of those causes of action are included in the Agreement for Binding Arbitration. Accordingly, Living Southern respectfully requests this office to decline any further handling of this dispute as it is contrary to the Agreement for Binding Arbitration entered into between the parties.

None of my complaints are new. I can provide witnesses who heard me say I didn’t want carpet. Tru and Living Southern failed to come to the FHSMV inspection. The repairman Living Southern sent failed to do repairs-half did some repairs and refused to make repairs. I can provide pictures, audio,and messages sent to FHSMV . Hurricane Sally did not cause extensive damage to the home I can provide pictures And a letter from my insurance company stating the home suffered from poor workmanship and construction -Preexisting damage from bad construction. No repairs were done before Mrs Citrin she withdrew because she didn’t want to pay a lot of money to win the case. Daniel Weber and others came to my, they saw the repairs still needing done. I can provide pictures on repairs still needing done. I was offered a raw deal with the understanding I withdraw all complaints-tru would provide some materials for minor repairs only. If the home is livable and all repairs have been completed-why offer me a raw deal? I can provide a year of text messages asking for repairs to get done while the home was under warranty . The last attorney stated he wasn’t willing to pay out alot of money or time.
