Possible CFPB/Reg F violation -- I am the debtor for a mortgage where servicing/ownership rights were transferred to LoanCare, LLC. My wife recently was laid off so I contacted LoanCare asking for possible loan assistance. I was advised of a forbearance option and received an offer letter that detailed payment amount and length of forbearance. I am willing to provide the offer letter for further evidence. I have a history in working collections, both mortgage and consumer, so I thought the forbearance letter omitted some key details. When calling LoanCare's customer service to further inquire about the forbearance offered, I was then advised of additional terms to the forbearance that were not outlined in the offer letter. Namely, the mention of a balloon payment was not included in the offer letter. I only discovered this information in a verbal exchange with customer service. The letter only stated I was allowed to make $0 monthly payments for the next 3 months. Delinquency would not pause during this forbearance, which is understandable but not much of a payment assistance plan, in my opinion. My history in this field allowed me extra protection for an otherwise, possibly detrimental situation that could have resulted in foreclosure for not being able to afford a balloon payment. Resolution Sought I would like to see the business offer a formal apology for omitting key details of a "payment assistance" program and possible short-term loan forgiveness (pausing payments with no penalty of delinquency) to aid in my financial hardship. The business needs to address their overall written communication shortcoming for future customers that are not as well versed in mortgage details.
