We were quoted and had a contract to put on an addition to our home for $54,170.00. The upfront book job fees and obtain permits were $5,000.00 and the second draw to start construction was an additional $15,000.00 which was paid in full in April 12th of 2021. On April 27th work started on our house tearing the front porch apart, siding off our house and the trench was being dug for the footer and concrete walls were under way. The contractor was only available on site for maybe 2 full days and has not been back since, especially considering that no permits were even filed and on record but yet we were charged for them handling it. The last time he was there, our driveway has been destroyed from the earth removed, bare electric wires for the garage are still exposed, water lines and gas lines are still exposed, siding is still tore off, the front porch is still in shambles and subsequently the back porch near the foundation dig is starting to undermine and fall into the exposed hole. Majestic gave us a balance sheet of what was done and what was paid to them but never an actual breakdown of every item line listed, nor a balance of our money inflation should be in an interest accruing account. We have asked in a polite and timely manner all breakdowns and have gotten denied. As it stands, $8,070 is the remaining balance of the $20,000 and after speaking with several independent contractors, they quoted his work ( according to his balance sheet) to be no more than $5,000. Resolution Sought After all the damage done to our property with no intent on coming back until a new contract(that was recently updated) was signed or having a release form signed, the balance of $8,070.00 along with an additional $6,930 should be returned. I fully understand Majestic's employees should be paid, equipment rentals should be paid and the drafting of plans should be paid, however not $11,930.00 worth especially without a complete breakdown of all costs.

The owner of Majestic, Tom, called back and tells me this is in the hands of the courts and has been since May 15. He does not want to send any court papers, but says complainant knows that the courts are overseeing this.

I actually just responded back out to the Business Consumer Alliance stating, the matter of myself vs Majestic Custom Carpentry has been in the court system since May 15th is categorically false. We have received no such notice and of that's the case, I would like Mr Fenley to provide such proof. I received a general release form on June 11th from John J. Flaherty attorney in Willamsville NY and our representative has responded to such letter. Not only that, we received an updated building contract from Majestic on May 28th 2021, so the notion of the matter being in the courts since May15th is baseless.
