Contracted with Frank Dinius, owner of McGraw Lawn & Landscaping LLC, on May 2, 2022, to perform landscape work around the perimeter of our home. According to our contract work was to begin on May 16 and was to include creating a clean new edge around all beds, level & narrow bed area near garage; grass seed & straw altered area, remove unwanted plants/tree/shrubs and haul away, grind stumps and remove all wood chips, transplant existing plants/shrubs to new locations, plant new plants/shrubs/tree purchased by homeowner, put down professional-grade weed fabric in beds, and place 4 inches of black mulch in all beds. The time given in the contract for job completion was 2-3 days. When it was discovered that an automatic edger could not be used on the premise (no sprinkler info/map available) and the job would need to be done by manual shovel an additional 1-2 days to complete the job was added. No work has been done on the premises as of today June 1, 2022. No show after no show and every type of excuse has been given. The last correspondence was by text Wednesday morning of May 25, 2022. In one text, the owner, Frank claimed that "on my kid's lives I will come out tomorrow". He did not come out on May 26 and we have not seen or heard from him. He hasn't answered his phone or replied to our message/text. We believe that McGraw has violated Indiana's Home Improvement Contract Act (HICA) in more ways than one and want out of our contract with him. Resolution Sought We no longer want to do business with McGraw Lawn and Landscaping and want our $2000 deposit back so we can go our separate ways.
