I resided at an apartment complex owned by On Point Property from November 21st 2021 until January 1st 2022. Their on site manager Nancy harassed me since day one. Sneaking into my apartment as soon as she thought I left, consistently peeking in my windows, going into my mailbox that is locked and needs a key to get into and keeping certain mail from me. Due to this constant harassment that the landlord refused to do anything about even ignoring my phone calls I decided to give my 30 notice of vacating on December 13th. After moving out the landlord is refusing to give my security deposit back stating I forfeit my deposit because I neglected to put my 30 notice in on exactly the first of the month. I was told I only needed to give a 30 day notice which is what I did. There was no damages to the apartment and my rent is paid up to date. There's no reason they should keep $500 . Especially after the behavior I had to put up with with their employees. I am living at the econolodge right now because I could not stand another day dealing with the manager who disrupts my privacy rights as well as going through my mail and my apartment. The person she is referring to named Nancy is only a tenant there. She does help us occasionally with opening up apartments and does the daily water readings for owner. She is not an employee nor a manager. If she had told someone she was, she is mistaken. I believe if someone actually did what she accused her of, the police should have been called and my office would have given her that advise. Im sorry the tenant doesn't understand New York law, but a 30 day notice is very well known. If your tenancy is from 1st to the 1st, then a 30 day notice must be given prior to the 1st, not December 13th in middle of month. If she was moving Jan 1, then it was a 17 day notice. A refund must be given if we re rent apartment, but we haven't. This tenant will experience the exact same thing wherever she lands in New York State.

They have given me my security deposit back after fighting for it hard. They know they neglected to provide me with the proper information a lot of their reasons why they wouldn't give it to me was not stated in my lease and they even said themselves that the employee that has since left the company had left out that info. I did not move out Jan 1st as they stated. I turned the keys into their on site manager Jan 7th if I am correct. But again they have since given me my full refund once I provided information from wny law showing I have knowledge of my rights and I was going to take it to civil court. They really need to do something about employees. Make sure they give ALL information properly to every tenant and they really should ensure every lease includes the information that was lacked in my lease. As well as their on site manager who breaks privacy laws and harassment laws .
