OpenSea banned my account for no reason and keeping the money they owe me for their fraudulent reasons. On June 15, 2022 I received a email from OpenSea saying that my account was disabled for violating TOS (As Shown in the Screenshots). I went to the OpenSea website and my account was banned for real. I am not sure for what reason they did this to me because I haven't done any recent activity with my NFTs nor tried anything wrong on purpose. I have raised a support ticket but their answer was very genetic "While unfortunately I'm unable to disclose additional details, I have reviewed and can confirm your account was disabled for violating our Terms". Also I have received an email from OpenSea support on December 3, 2023 about how I made several sales on OpenSea (As Shown in the Screenshots) but I have never received any of the payments from the several sales that I have made in my Meta mask wallet. So not only OpenSea banned my account but also not paying me for the several sales that I have made, this is theft and fraudulent activities which is a cyber crime/illegal. Resolution Sought I just want OpenSea to unbanned my account so I can be able to receive the payments from the several sales that I have made on OpenSea.

OpenSea is a noncustodial web3 marketplace in which users engage in peer-to-peer transactions using their own personal wallets, which wallets are outside of the control of OpenSea. OpenSea does not hold or "custody' NFTs or cryptocurrencies on behalf of users. OpenSea does not control the NFTs or cryptocurrencies in the wallets of its users. On June 15, 2022, OpenSea banned wallet address 0x8CFAfe86649EbF9A11C045cb10e83b8c839705a9 and sent a notification of the ban to the email address associated with this wallet address. The email notification encouraged the recipient to contact OpenSea if they believed the ban was in error. Specifically, the message read: "If you think there's been a mistake, you can reach out to our team at support@opensea.io to get help." Sixteen months later, on October 20, 2023, the user wrote into the OpenSea Help Center. Approximately two hours later, OpenSea responded, informing the user that: We have reviewed and confirmed your account was disabled for violating our Terms of Service. Specifically, your account was disabled for infringing or violating the intellectual property rights of others through the creation of NFTs in the collection (Bored Ape Yacht Club). Id. The user did not further contact OpenSea. OpenSea takes the intellectual property rights of creaters seriously and does not allow projects infringing or violating those rights to be displayed on its website. In agreeing to the OpenSea Terms of Service, users agree they "will not violate any law, contract, intellectual property or other third-party right" and further agree they will not "Infringe or violate the intellectual property rights or any other rights of others." See https://opensea.io/tos. As to the reference to the user having an email from OpenSea regarding sales of NFTs, the user has not provided the screenshots referenced in the complaint. However, a review of OpenSea's business records reveals that wallet address 0x8CFAfe86649EbF9A11C045cb10e83b8c839705a9 did not create any content that was sold using OpenSea's services and OpenSea did not to reach out to the user to state otherwise.
