I hire Patrick to dig my basement and concrete for $9k. Then I ask him to dig the back of my bottom of the kitchen to the basement to even it out. To make the basement longer and have more space. Which make the $9k job turn into $17k job. The job is for him to dig from kitchen to the basement and even it out. And of course it has a wall in between the kitchen area and basement. In which he suppose to dig through and collapse it so the kitchen area can even out to the basement. It also include for him to build a foundation walls and concrete the floor. I paid him in full when he finish the dig and concrete and text him to make sure he's coming back to demolish my wall once the house foundation is rebuild and is safe for him to come back and demolish the wall between the kitchen and basement so he can even it all out. And he agree and said okay. Once the house foundation is finish. I text him to come demolish and he said ok, and once he arrive he told me is $2.5k extra for him to demolish the wall. And the $17k wasn't included and I already paid him in full and his job is finish. So basically I paid him $17k to do everything except breaking the wall to even my basement out. Which make no sense because why would I want to dig my basement down and leave it like that? Why would I pay you extra $8k for you to dig and have a small room that can't be access at all? He also has no contract for me to sign and want me to text everything to him. Which should've been a red flag. Resolution Sought He's refusing to demolish my wall in which I have to hire someone else to do it so I want him to give me my money.

The agreement via text with Ms. Dung is as follows: Basement 19 inches (agreed after several changes in depth) $9,000.00 To even it out $2,000.00 Kitchen dig down basement with foundation $4,500.00 Extra foundation wall $1,500.00 Total $17,000 Given Today (01/22/2024) $4,500.00 Owe $12,500.00 Client had paid in total on 01/24/2024. Ms. Dung informed me that when she finished her project of framing the extension she would let me know. That extension was never discussed or had been a part of any of our conversations.Two months later in March she contacted me informing me that the she wanted the wall to be removed and to remove the remains of the wall debris. However, the cemented wall on that area was done on my end.I quoted her $2,500.00 to demolish the wall and the removal. I have to bring a dumpster which costs money and workers for that work which was not discussed in any of our conversations or even quoted. I am very diligent with our work. When I’m discussing of digging down from kitchen side to dig down and even out into the basement, my dad and I explain how we wanted to dig down and into the basement meaning we want it to dig out into the basement. Why would I just want to dig a hole and leave it like that? It make no sense. The wall is literally dirt that is a part of the digging process. So of course it suppose to be a part of the digging. And when Patrick finish digging down, I text him that when he finish, would he be back to finish the job since he need the foundation to be down to finish that part of digging. If you pay someone to dig down from the kitchen into the basement. Would you accept them to just dig a hole? What am I suppose to do with a hole that I pay thousand of dollar for? When someone say “digging down INTO then basement” it mean dig down and into the basement. And when I text him he “ageee” to come back to finish. He never said anything about it being extra until months later when I text him to come back. Even through text he never said it cost extra until he arrive at my house in March. If a job would cost extra, he should told me when I ask him.
